ABSTRACT: While France wonders how the secular character of the Republic sholuld change, and President Macron presents a project to profoundly revise 1905 separation law (Loi concernant la Séparation des Eglises e de l’Etat), Italy is still tryng to update 1929 minority cults law (“sull’esercizio dei culti ammessi nello Stato”). The parties that should implement the sucularity principle and religion's freedom, don't have a clear political direction. However, preparing for the future is strictly necessary in these times of health, economic and social emergency.

Secularism and Bilateralism Thirty Years after the 1989 Landmark Constitutional Decision. The Italian Secularism tested by Islam and atheism

ABSTRACT: In 1989 the Constitutional Court stated that secularism (laicità) is one of the supreme principles (principi supremi) of the Italian constitutional order. On the basis of articles 2, 3, 7, 8, 19 and 20 of the 1948 Constitution, the Court said that secularism does not affirm indifference of the State towards religions; rather, it sustains the protection of religious freedom in a context of cultural-confessional pluralism. With this essay the author examines the way the Italian supreme principle of secularism has developed in the last thirty years, especially in relation to the so-called bilateralism method (as stated in articles 7.2 and 8.3 of the Italian Constitution) and in the light of today’s pluralism, which is characterized by the presence of new collective organizations, such as those referring to Islam and atheism.

La resilienza della laicità a fronte del terrorismo cosiddetto islamista - di Nicola Colaianni

1 - Sul giornale “il manifesto” del 4 novembre scorso compariva una vignetta raffigurante un coltello da cucina piantato a 60-70 gradi sull’orizzonte con la scritta “terrorismo - la curva sale”. Come quella dei contagiati dalla pandemia, a salire era anche la curva degli attentati terroristici. L’ultimo, e più devastante con quattro persone uccise e altre ventidue ferite, era avvenuto poco più di ventiquattr’ore prima, il 2 novembre, a Vienna ma neppure una settimana prima, il 29 ottobre, s’era registrato l’assassinio del sacrista e di due donne colpevoli di pregare nella cattedrale di Nizza, che aveva fatto seguito a quello del professore Samuel Paty il 16 ottobre nella regione di Parigi. L’efferata sequenza Parigi - Nizza - Vienna nel giro di due settimane confermava che il terrorismo sedicente di ispirazione religiosa non conosce sospensioni temporali neppure nell’anno del coronavirus ed è capace di operare ovunque in Europa. The Resilience of the Secularism in front of the so-called Islamic Terrorism

ABSTRACT – The latest attacks by so called islamic terrorism in Europe highlighted the existence of severe  investigative and pre-emptive shortcomings.  However the bills France and Austria are debating about plan to counter a misleading “radical Islam” or “politic Islam” with rules that end up compressing the freedom of worship  of the Muslims. Against the separatisms, permeable by the terrorist narrative, the public space, that promotes the living together, remains the place of de-radicalization and resilience of the secularism.

The hospitality of the right or the arduous journey of human dignity

ABSTRACT: The paper, starting from the idea of law as a producer and, at the same time, an expression of the hospitality of a political community investigates the progressive opening of state legal systems to the "stranger" in the age following the Universal Declaration of Human Rights. The paper highlights the difficulty in the implementation of an effective multi-level protection of fundamental rights and the resilience of the ancient paradigms of Westphalian sovereignty. In conclusion, the role of the right to religious freedom is underlined as the right to hospitality for the stable construction of multicultural and multireligious societies.

The hidden virtues of laïcité. About certificates of virginity and some related topics

ABSTRACT: The purpose of the present study was to examine the announced France’s draft bill to prohibit the issue of certificates of virginity. To do so, we first reconstructed the terms of the current debate provoked by the bill. Then, we examined the recent WHO statement which establishes that States should develop plans of action to encourage the elimination of the practice of so-called virginity testing. Finally, we illustrated the advantages and the risks of any solely restrictive approach in this matter.

Secularism and Right to the Building of Worship

ABSTRACT: Article 19 of the Italian constitution guarantees the right to worship as one of the three subjective public rights, together with the right to profess one’s own creed and propagate it, through which religious freedom is manifested. However, people belonging to certain religions face obstacles in having places where they can perform their rituals. Particularly, the request to build mosques on Italian soil encounters many denials, especially of a legislative nature. The essay analyzes, also through the reference to concrete cases, the problems in the field and proposes to reflect on the concept of space where people can develop their personality and fulfill the mandatory duties of political, economic and social solidarity.

The Muslims of Thrace and the case Molla Sali c. Greece. A historical and legal itinerary between religious pluralism and demands for equality

ABSTRACT – The article is inspired by the Molla Sali v. Greece case, resolved by the ECHR. Starting from this case, the article analyzes the complex historical development of the legislation relating to the Muslim minority in the Greek region of Thrace. In particular, the article deals with the prerogatives of the mufti in the judicial field and the application of Islamic law to relations among private individuals. In addition to the treaties concluded between the decaying Ottoman Empire and the main European powers, the article explores the corresponding implementing rules in the Greek legal system. Finally, the article proposes some critical considerations about balancing the principle of equality and the rights of minorities.

Multicultural societies and protection of food identity: some reflections on ritual slaughter.

ABSTRACT: The intensification of migratory flows and the demographic increase of the population of the Islamic religion in Europe now make it unavoidable to consolidate that process of cultural integration between different ethnic, linguistic and religious components, which had already begun a few decades ago in Western countries and aimed at defining of a new model of open and pluralist society. This process calls into question, in various areas - including that of food protection - the values ​​of dignity, freedom and equality on which European democracies are founded, imposing the search for new balances between potentially conflicting interests. This contribution aims to investigate the compatibility profiles between respect for the food identity of religious minorities, the protection of human health and food safety and the prohibition of causing unnecessary suffering to animals, to highlight whether the principle of neutrality accepted by the current EU legislation is indeed the most suitable for promoting the fundamental values ​​of European society.

ABSTRACT: Using interdisciplinary lenses, this article examines the cultural, social, and juridical status of the Alevis in Turkey and Western Europe. The ongoing social exclusion and discrimination against Alevis in Turkey make their everyday lives challenging. In Europe, Alevis organized themselves in associations, forming vibrant transnational communities. They struggled for recognition of their cultural-religious rights, and in some European countries, they are given special status. As we will illustrate, their recognition in Europe significantly effected in their case in Turkey but failed to emancipate them fully and posed further issues to tackle with and for the Alevis in Turkey. Gedik and Birkalan-Gedik present sociological, historical, and political contexts to understand the current realities of Alevis in Turkey and Europe, mostly based on their ethnographic studies. Madera examines five cases between 2007-2016 which were presented by the Alevis to the European Court. We conclude that currently, Turkey does not try to suffice the European requirements, namely, the implementation of policies aimed at guaranteeing adequate protection of the collective dimension of religious freedom in a way consistent with European directives.

The Development of Laws and Jurisprudence in Islam: Religious and Imperial Legacies - di Gloria M. Morán García

ABSTRACT: This article analyzes several open scholar debates regarding the Muslim legal system, from the conventional narrative of its formation and the triumph of the Traditionalist movement to the disputed question of reciprocal legal influences with other religious and secular juridical systems. This research tries to avoid two epistemological risks: first, the dangers of a simplistic binary debate like traditionalists v. revisionists, religious v. secular, or even Sunnis v. Shiite reducing the analysis to an ideologically polarized and ineffective dispute; and second, the improper use of juridical neologisms applied to the Islamic legal system, mainly from codified European continental law and English common law as a result of the Orientalist, colonialist, and secularist mentalities that, instead clarification create confusion. From a hermeneutical point of view, two characteristics to keep in mind: 1) the notion of divine law and its legal implications; and 2) the relationship between law and theology that is not correlative to the connection between secular legislation and ideology. From a comparative point of view, three challenging questions to address: 1) the distinction between Usul al-fiqh and Usul al-qanun often blurred in practice showing the complexities of the relationship among religious, legal, and political structures under Muslim ruling; 2) the intertwined relationship among Sharia, fiqh, and siyasa with pre-Islamic administrative, legal, and judicial traditions; 3) Jurisdictional pluralism in the Islamic legal practice concerning non-Muslim minorities.

Il cardinale Gasparri, Francesco Saverio Nitti e la basilica di Santa Sofia - di Giovanni B. Varnier

Venerdì 24 luglio 2020 la Turchia, o meglio il suo premier Recep Tayyip Erdoğan, ha riaperto al culto islamico il simbolo stesso di Istanbul rappresentato dal complesso monumentale di Santa Sofia. Una vicenda triste per la civiltà, che vede un gioiello artistico di valore universale piegato al nazionalismo religioso. Per la verità l’edificio non è nuovo ai cambi d’uso, come non lo sono altri manufatti di pregio che hanno attraversato i secoli, ma in questo caso non si tratta di un nuovo utilizzo ma di un ritorno al tempo della dominazione ottomana.  Tuttavia, questo non è un ritorno alle origini, perché - come sappiamo - Santa Sofia, costruita per l’imperatore Giustiniano in soli cinque anni dal 532 al 537, è considerata il capolavoro della nuova architettura basilicale bizantina quale espressione della “romanità cristiana e universale della cultura giustinianea”.

New Frontiers of Culturally Motivated Crimes. The Intercultural Method-Approach as a Tool to Prevent and Counter Religion-Inspired Crimes

ABSTRACT: This paper analyses the so-called culturally motivated crimes, focusing the attention on legal measures that may prevent and counter such misconducts. The Author points out some methods, such as those referring to the transformative accommodation, which may be able to solve conflicts between the need to safeguard human rights, including those related to religious freedom, and the Government's priority to protect public safety. From here stems the investigation on the so-called Islamic terrorism that, under some aspects, can be seen as a new frontier of religion-inspired crimes. This, on the other hand, suggests a multisectoral approach, which is important in order to deal with very serious threats while promoting intercultural and inter-religious integration.

Islamic finance compatibility with the Italian legislation

ABSTRACT: Some verses of Allah that were revealed to the Prophet Mohammad in Quran were regarding economic issues. Further they were enriched in the legal framework of reference by other sources of Islamic law “Sharia” like; the Hadith (the sayings of the Prophet transmitted first orally and then transcribed), the Sunna (the tradition dictated by the words and actions of the prophet and the remembrance of the prophet statements by his first followers), and finally of Fiqh that is the Islamic jurisprudence dictated by the doctrinal interpretation of the various juridical schools. Islamic finance products which are derived from Sharia based on religious principles are very compatible with the system of traditional financial products, except for some ethical (excluded by the Sharia supervisory board) and fiscal (to avoid double taxation measures of some Islamic finance transactions), which could enhance the market attaractiveness prespective. The present study aims to investigate and identify the regulatory changes that can be implemented in the Italian legislations to make them compatible with the applicability of the typical Islamic financial contracts.

The ʻAnti-veilʼ Ruling of Lombardy Executive Committee and the New Paradigm of Public Security

ABSTRACT: On 10 December 2015, Lombardy Executive Committee approved a ruling which forbids the access to some public facilities to people who wear types of clothing aimed at covering the face. This ruling, whose object is to prevent any dangers that could affect public security, risks to discriminate Muslim women who wear an integral veil for religious reasons. With a controversial judgement, the Milan Court of Appeal confirmed the legitimacy of the provision. Contrarily to the opinion of the Court, this essay aims at proving that the Regional ruling couldn’t effectively get through a proportionality test, given the excessive intensity of the prohibition. In addition, other doubts are risen by the meaning of public security expressed by the provision.

Next, I will take into account the impact of the constitutional regulation of the religious factor on halal certification. ABSTRACT: The essay analyzes the legal issues related to the presence of religion in public spaces. The thesis is that it is necessary to consider the various issues (religious building, religious symbols in public buildings etc.) on the basis of the public character of the space. In this way it becomes possible: a) to compare the various issues; b) identify the tasks of public authorities, which must make spaces available to religion and must not discriminate access to spaces. However, there are exceptions to the rule necessary to protect children in classrooms.

The ban on the integral veil in Italy and Spain: the Lombard and Catalan cases

ABSTRACT: In recent years we have been able to appreciate how phenomena such as immigration and globalization have transformed the religious decoration of European countries. Italy and Spain do not represent any exception, because in the streets of their towns and villages there is a growing religious diversity that every day does not stop increasing. That this means people who have arrived to Italy and Spain searching of better prospects for the future but without forgetting their customs, traditions and religion. The problems arise when in use of religious freedom, this people try that the host society admits or tolerates certain religious practices, foreign to the European Judeo-Christian tradition, which could collide with the European legal order. One of those controversial practices has to do with religious symbology, specifically, with the integral veil that Islamic women carry, mainly because of the security problems. By this reason, this article tries to describe the legal situation of the integral veil, analyzing and comparing the ways in which have been regulated in Italy (Lombardy) and Spain (some Catalonian municipalities like Lleida or Reus). The jurisprudential solutions emanating from the courts of both countries are also studied.

ABSTRACT: The right to religious freedom is in profound transformation on both sides of the Mediterranean. While the Muslim presence shows European difficulties in the treatment of the collective dimensions of this right, the southern shore is confronted with the demands connected to the individualization of beliefs. Freedom of religion before European Courts

ABSTRACT: This essay aims to investigate the content of the right to religious freedom in the European Court of Human Rights’ and the EU Court of Justice’s case law. As a matter of fact, the approach of these courts appears to be very different. While in the Strasbourg Court’s case law this right is gradually recognized more and more clearly and the legitimate restrictions foreseen in the Convention are interpreted with increasing restraint, the Court of Luxembourg rarely applies the right recognized by art. 10 of the EU Charter of Fundamental Rights in a direct way and often decides the cases through the lenses of an extensive interpretation of the EU anti-discrimination law.

Confessions and religious communities in Eastern Europe, religious pluralism and legislative policies of the States

ABSTRACT: The intervention reconstructs the supporting lines of the activity of the national office of each legal system in charge with the maintenance of the relations between the State and the confessions and religious communities in the Eastern European countries. Through this perspective, the ecclesiastical politics of 19 countries is reconstructed, highlighting the genesis and the peculiar characteristics of their legislations and highlighting the underlying lines that are at the root of the choices of their systems. Particular attention is dedicated to the definition of the different models to which the States refer in relation to their effectiveness in maintaining religious peace while respecting the principle of equality and freedom among the various religious confessions. The article aims to be a contribution to the development of guidelines for relations between the state and religious confessions in Europe.

Halal alimentation and the challenges against french laïcité: the request of alternative menu in the school canteens

ABSTRACT: The article will concern the debate about the balance between secularism and religious-driven prerogatives through a narrow focus on the diffusion of halal food in France. In particular, I will shed light on the increasing request of shari'a-compliant food by Muslims in some social spaces, for instance in the school canteens. My research will unfold its arguments in two sections. In the first one, I will address the recent development of halal market in France and try to frame the reasons of such burgeoning activities - revival of Islam or neoliberal marketing strategy? In the second part, I will consider the sentence of Dijon Administrative Tribunal, which in 2017 abolished the decision of the mayor of Chalon-sur-Saône of suppressing halal menu in the school canteens. The verdict might be read as an opinion favourable to Muslim’s prerogatives. Nonetheless, the rationale of the judgement does lie indeed in the defence of the “best interest of the child”, whereas the basic principles of French laicité were not put into discussion.

The relationship with Italian Islam: from the proposals of ‘Intesa’ to the ‘Patto nazionale

ABSTRACT: According to statistics, Muslims living in Italy are currently just over 1.6 million. However, despite this significant presence of Muslims on the national territory, the vast world of Islamic associations has not yet managed to sign an Intesa, an agreement that religious minorities can establish to regulate their relations with the Italian state. The reasons why Islam does not have an agreement are mainly two: the absence of an authoritative subject, representative of Italian Islam, able to act as an interlocutor with state institutions and the incompatibility between Islamic cultural values and those of a secular state. Nevertheless, covering all the stages of dialogue between the Italian government and the Islamic associations from the nineties until the conclusion of the Patto nazionale (2017), this work aims to show that the condition of legal vacuum depends on unfounded prejudices towards Islamic culture and on the lack of political will to come to terms with Islam.

Dealing with the contentious points of the integration (about “forbidden” greetings and principle of non-discrimination)

ABSTRACT: Some Islamic believers adhere to a rule of behavior coming from a particular reading of the traditions concerning the life of Muhammad, so they do not shake hands with people of the other sex outside their own restricted family circle. The present paper analyzes the potential impact of such a choice, if it is carried out in the work context and it infringes specific internal company rules, which require employees to not discriminate against customers on the basis of sex. The Author, in accordance with a recent decision of the Swedish Labor Court, affirms that the limitation of the freedom of the worker can be considered a case of indirect discrimination for religious reasons. However, demanding that the woman abstains from shaking hands with persons of her own sex, as suggested by the Court, is not required by the principle of gender equality, and is not coherent with the very personal nature of the act, according to the Author.

Organized violence and religious affiliation: the case of Isis

ABSTRACT: This paper seeks to address the crucial issue of organized violence from a cultural perspective analyzing the case of ISIS, tipically considered as religious group. It intends to elaborate some of the key questions of the debate on the links between religion and violence. The religious nature of ISIS will be disputed throughout its birth and expansion during the U.S. invasion of Iraq and the Syrian conflict: more specifically, the paper aims to shed some lights on the grounds underlying the decision of western foreign fighters and Jihadists to join with or refer to a group of fanatics fighting in the faraway land of Syria. The research methodology is based on an interactionist approach on violence in order to avoid focusing on psychopathological (‘they are violent because they are mad’) or ethical-religious aspects (‘they are violent because they are driven by a bad religion’): on the contrary this paper aims to investigate Jihadist violence in its relational and symbolic aspects, as part of a socio-cultural way of life. In the end, the impact of this approach on possible prevention programs will be touched on briefly.

ABSTRACT: With this article, the Author outlines the legal issues involving the atheism in France, analysing them in the light of the principle of laïcité. France has a long history of criticism of religion. Many philosophes of the Enlightenment, for example, have provided the classical writings in this field. In this sense, they were able to aliment two major streams of thought of the magmatic French atheism: one is based on the horizontal influences arising from the effect of increasing worldwide travel with the discovery that people do not necessary share the same views and beliefs about the nature of human being; the other is centred on vertical arguments bubbling up from the past in a very form of scepticism and realism. With its multi-faceted and articulated view, the French atheism has also been promoted by a number of movements devoted to arguing the case for non-belief and for its political expression in laïcité. In this manner, the Author tries to demonstrate that, since the Great Revolution and during the long history of the French constitutional system, laïcité de combat and atheism has been influencing each other in a constantly shifting process of mutual adaptation.

The concordat dynamics between Holy See and Islamic State

ABSTRACT: The article analyzes the concordat dynamics between Holy See and Islamic States developed after the Second Vatican Council. The concordat, in its various forms, is the main instrument through which is regulated the system of relations between States and Catholic Church. Its use has been tested successfully in various Islamic States, and sometimes even with heterogeneous formulas, because of differences that distinguish the individual systems, trying to translate the concepts of autonomous of Church and collaboration with States in forms legal acceptable to Muslim tradition countries. The exhortations in the Al-Azhar Declaration are directly connected with the possible development of bilateral activities between Holy See and other Islamic countries and this can also strengthen the peace among peoples and the interfaith dialogue.

Granting Islamic religious ministers admission to prisons, amid long-lasting issues and reformation perspectives. The Agreement between the Prison Administration Department and the Islamic Communities Union.

ABSTRACT: As religious diversity in Italian prisons grows, accommodating prisoners’ religious needs tries legal paradigms and instruments out. In 2015 the Prison Administration Department signed an agreement with UCOII, one of the largest Islamic associations in Italy, in order to grant admission in prisons to intercultural mediators and religious ministers. This article seeks to situate the covenant in the wider context of the Italian legal protection of religious freedom in prison, highlighting three main purposes of the agreement: providing Islamic prisoners with religious assistance, enforcing rehabilitative programs and combating violent radicalization in jail. After two years the experience has shown good evidences. Nonetheless, contended issues still remain unsettled. While evaluating feasible solutions, the article advocates a legislative intervention that could assess criteria and procedures for religious ministers’ access to prisons fulfilling the principle of equality and non-discrimination.

Between religious freedom and security issues: the prevention of jihadist radicalisation in prison

ABSTRACT: Faith constitutes an essential aspect of prison life. Its relevance has been emphasised in recent times because of the religious pluralism that characterises the current prison population. In this scenario, the rise of jihadist terrorism has shed light on the problem of radicalisation in prison, already known and studied by the experts, which poses new challenges for policymakers, prison staff, and detainees. Prison Administration has been focused on religious freedom, its boundaries and its relationship with religious extremism and has already adopted some measures to combat and monitor jihadist proselitism in Italian prisons. This paper provides an overview of these anti-radicalisation strategies in prisons, highlighting unresolved issues. These include the lack of an integrated plan with regards to prevention of radicalisation and de-radicalisation, not limited by the prison context. This paper further highlights the challenges in devising policies that address security concerns without sacrificing religious freedom and diversity, as provided for by the Constitution.

Tax subjectivity and taxability of business activities held in religious places

ABSTRACT: The activities of ecclesiastical institutions, different from those of worship and religion and carried out by entrepreneurial method and rules of the free market, are subject to ordinary taxation. Otherwise, according to our Supreme Court and the European Court of Justice, they would go against the ban of so called incompatible state aid (art. 107, § 1, TFEU), as the status that every national law acknowledges to a artificial person is irrelevant. The Islamic cultural centers, the Sikh Gurdwara are generally in a limbo with a possible discrimination in the enforcement of the regulation under art. 8 of the Constitution. This paper, however, points out a few associative models, that the ecclesiastical institutions could implement so that their religious places can enjoy at least the common exemptions.

Secularism in the shadow of the minarets: the constitutional principle of secularism in modern and contemporary Turkey

ABSTRACT: The present essay deals with the so-called ‘laiklik’, namely the Kemalist understanding of the constitutional principle of secularism implemented in the Turkish legal framework over the last century. The analysis takes as a starting point the establishment of the modern Republic of Turkey and focuses firstly on the staunch protection of secularism by its traditional ‘guardians’ (i.e. the army and the Constitutional Court). In particular, it is argued that the rhetoric of secularism has been exploited by the ruling élites with the aim to curb religious, cultural and political pluralism. Subsequently, the paper investigates the controversial policies adopted by the AKP - the moderate pro-Islamic party in power uninterruptedly since 2002 - and the rule of law crisis recently occurred in the country. In this regard, the author eventually seeks to assess the aftermath of the coup attempt failed in July 2016, by giving special attention to its short and long-term implications in the light of Turkish secularism.

ABSTRACT: The article examines and comments the contents of the legislative proposals c. 2976 and c. 3421 (Garnero-Santanchè and Palmizio) and their unconstitutionality profiles . At the end of this parliamentary term, this examination is also the basis for thinking about political and normative necessity of another approach to Islam and, at the same time, revitalizing the Agreements instrument and the general law of religious freedom, so that they can constitute a concrete antidote to the slow and creeping drift of the normative reorganization of the law on the admitted cults.

Sharia Courts. History and evolution of Muslim courts in the United Kingdom

ABSTRACT: In the last thirty years the United Kingdom has experienced the formation and surge of so-called Sharia courts or councils, unrecognised Muslim tribunals with purpose of settling disputes using Islamic religious law. Their stated objectives include providing advice and assistance in the operation of Muslim family life, establishing a bench of scholars to operate as a council, making decisions on matters of Muslim family law, and promoting an enlightened practice of the Muslim faith by Muslims living in the UK.

This paper analyses the origins, evolution and functioning of these councils, with emphasis on the lively public debate initiated in 2008 following the Archbishop of Canterbury’s remarks and followed with the bill proposed by Baroness Cox. An overview of the relations between Sharia councils and the State is presented, while providing insight on future scenarios.

Freedom of Religion and Freedom from Religion in Morocco: The Interpretative Revision on Apostasy

ABSTRACT: The essay analyzes a recent step taken by the Kingdom’s Ulama that distances from the traditional meaning of apostasy and of the penalty given for this offense. According to this document, Murtadd would not be the one who leaves Islam for another religion, but the one who betrays the group he belongs to. Apostasy was therefore political, not doctrinal. In this sense, the document represents an essential progress for the qualification of religious freedom in Morocco (on the same way already indicated by the Marrakesh Declaration).

Religious prevention and de-radicalization measures to the test of secularity (at the margin of some of the Court’s measures of Bari).

ABSTRACT: The article examines how the terrorist emergence of Islamic matrix has reproached the issue of reconciliation between the need for security and the protection of the rights of liberty, in particular religious freedom. It highlights the need to accompany, to purely punitive nature rules, the spread of a novel paradigm, covering preventive interventions, educational and formative, in order to promote intercultural and inter-religious integration. The decree of the court, which, in accordance with the principle of secularism, has prescribed, in view of the social recovery of the subject proposed for the application of the prevention measure, a process of de-radicalization, through the involvement of an intercultural mediator, on the basis of Guide-lines developed by the University of Bari.

Codes of ethics and Deontology in the fields of Labor, Market and Finance. Freedom of Conscience and the Transition from Oeconomicus Corporatism to Democratic Intercultural Cooperation

ABSTRACT: The paper analyzes the recent relevance of deontological codes, from which a process of enriching the concept of deontology seems to emerge. This is increasingly understood not only in a corporatist way as an ethics of conduct within the category of reference, but also in a democratic way as the ethics of service made to the polis by professional communities, which now, in the overall world of work, appear ethically inspired in the most varied ways. Following the development that freedom of conscience has experienced in its various forms of collective exercise, we are positively experiencing new patterns of work organization where deontology represents a synthesis between moral and law. Similarly, to churches, even some professional communities have useful, non-utilitarian relationships, and open to democratic intercultural cooperation, with their multiform and typical ways of working in the service of the human person, elected to lifestyles or spiritual missions. In order to encourage and extend this phenomenon of greater ethical accountability of free professions, some legal channels will be analyzed to better harmonize the use of those new deontological standards with legal rules in order to ensure balance and order at a general level, and to avoid the social dissociation in neo-corporatist groups.

Forbidden hate: the legal repression of hate speech

ABSTRACT: The aim of this article is two-folded. First, it offers a general overview of the legal repression of various categories of expressive behaviours ascribed to the notion of hate speech. Especially in Europe, such repression often passes through criminalization, long since used by law to suppress thoughts or points of view for some reason considered harmful. The social groups nowadays protected by such repressive measures, however, are different from the past: weak and/or minoritarian groups rather than strong and/or majoritarian ones. The second aim of this work is to identify the reasons for the legal repression of expressions, beliefs or doctrines certainly in many cases morally deplorable, yet protected by other high-ranking legal reasons: the principles of freedom of thought and speech. It will be noted that especially for untargeted hate speech not connected to a clear and present danger of unlawful actions, there is no general agreement about those reasons. Furthermore, they tend to be structured in justifications showing some typical flaws of, respectively, deontological and teleological reasoning: the former tend to be superficial as apodictic, generic and vacuous; the latter tend to evade the argumentative burdens of factual order from which their validity depends.

Pluralism in Marriage: the New Challenges of the “Overlapping Jurisdictions”

ABSTRACT: The challenges of the “new multiculturalism” in the field of marriage law regard not only which forms of marriage should be recognized by the State but also the forums in which marriage cases can be adjudicated and the role of faith-based laws and religious courts in democratic and secular legal systems. Religious groups increasingly ask for accommodation of their cultural identities; however, a growing skepticism concerning forms of religious jurisdiction is developing in regimes devoted to individual liberties, which employ public policy as grounds to vacate religious rulings. The present paper highlights the need for Western States to update and exploit the full potential of their legal instruments in order to prevent restrictions on collective and individual religious freedom in matters of marriage.

Which protection for the fundamental freedom of religious symbols?

Abstract: Starting from the analysis of the French Council of State’s decision on the case “burkini” (August 26th 2016), this paper examines the issues on the interaction between the acceptance of the religious minority’s symbols by the majority and the acceptance of the dialogue and cultural diversity. Taken into account is the process of secularism-neutrality of public space and the interference of the civil judiciary in the religious sphere declined in different models of secularism of the French, Italian and European jurisdictions.

Tra pochi giorni sarà trascorso un anno da quel 27 gennaio 2016 in cui 250 eminenti studiosi islamici , riuniti a Marrakech e provenienti da oltre 120 nazioni, hanno sottoscritto una “ Dichiarazione sui diritti delle minoranze religiose nei Paesi a maggioranza musulmana” rivolgendo l’appello a sviluppare una giurisprudenza islamica sul concetto di cittadinanza inclusiva di tutti i gruppi religiosi. L’incontro si era tenuto su invito del Ministero della Promozione e degli Affari Islamici del Regno del Marocco e del Forum per la Promozione della Pace nelle società islamiche , con sede negli Emirati Arabi Uniti. All’evento avevano partecipato cinquanta leader di altre religioni e rappresentanti delle organizzazioni islamiche e internazionali. L’incontro proseguiva lungo il cammino tracciato ad Abu Dhabi nel 2014 con la nascita del Forum for peace , inteso a mostrare al mondo che l’Islam “is a religion of peace and justice”, cui aveva fatto seguito nel 2015 un secondo Forum inteso a ristabilire “ the priorities of Muslim societies by rehabilitating hearts and intellects to a more thorough understanding of the salience of peace in Islam, the shariah, and our tradition”.

Decoding European islām. Intercultural law and sharī ʿ ah -compliant relations.

ABSTRACT: Since the beginning of the XXI century, Islām became a key-topic in the national and international discourse. In the contemporary pluralist and fluid scenario, the public visibility of Euro- Islām increases also as expression of Muslim communities’ demands and pressing needs. In light of recent tragic events and the exponentially growing European Muslim community, developing appropriate tools for effective and fruitful dialogue is thus of pivotal importance. Adopting a pluralist perspective, the paper investigates the multi-folded accommodation, adaptation and mutual adjustment techniques enacted amongst different legal cultures, orders and systems. Specifically, attention is paid to the reciprocally (non) adjustments of Islamic/Muslim laws to European domestic legal systems, and the implications of the interaction between sharī ʿ ah -compliant relations and intercultural law. The proposed analysis aims to decode the various forms of sharī ʿ ah -compliant modus vivendi enacted by European Muslims by shedding light upon the peculiarities of European Islām and the polychrome taxonomies of belonging to al-Ummah Islamiyyah . Relying upon field-collected data, the transplantation models of Islām in national legal systems are disentangled, whilst the discussion reveals new prototypes of state and social co-existence, constantly developed and reinvented at the crossroads amongst states, religions and traditions.

ABSTRACT: In 2008, a vivid debate was stirred by the lecture delivered in the Royal Courts of Justice by the then Archbishop of Canterbury. Public discussion and social commentary began to question the role that sharī ʿ ah was playing in the British society and the Sharī ʿ ah Councils were immediately identified as proponents of a "parallel" legal system. Whilst media coverage was causing much anxiety, the narrative on "inherently discriminatory" legal orders operating in the shadow of state law exponentially grew.This social critique soon brought to light knowledge gaps concerning British Muslim communities as well as Islamic and Muslim laws, specifically regarding family issues. Thus, the Ministry of Justice promptly commissioned a research project on these matters. Having had the privilege of being named amongst the researchers responsible for mentioned ministerial project, this paper intends to build upon the collected material and analysed data in order to shed light upon some key-findings concerning the British Sharī ʿ ah Councils. The proposed discussion also pays attention not only to the latest products of the academic discourse on faith-based justice, but also to the political debate on sharī ʿ ah -related matters, addressing two recently launched enquiries and a pending Bill introduced in the Parliament. pdf

ABSTRACT: This article addresses the legal condition of the Muslim minority in Italy, considering the progressive development of the sociological situation of various Muslim communities, approaching to Italy from different Islamic countries (from Morocco to Somalia, from Tunisia to Egypt) in the last 20 years. More in detail, the paper analyzes the current limits in the application of the constitutional norms concerning the agreements of cooperation (called “intese”) and Islam, and proposes an alternative and diffuse system of local agreements more fitting with the Islamic political tradition as well as with the fundamental rights of the faithfuls, in an even more parochial and multifaceted society.

The Cultural Impact of Islamic Mass Immigration on the Italian Legal System

ABSTRACT: Although Italy has been a country with a strong tradition of emigration, only in the last twenty-five years Italians have had to face the social, juridical and cultural problems related to high immigration hosted by this country. The majority of immigrants come from areas with Islamic religious tradition such as Northern and Central Africa and the Middle East. The cultural impact between the Italian Catholic tradition and the newcomers' faith and customs has been very strong, often problematic. The aim of this paper is to investigate the most relevant issues between the cultural and legal aspects of Islamic culture pertaining to immigrants living in Italy with the Italian legal system. The legal areas proposed for the investigation are related to self-determination, personal integrity and family law, especially for analyzing the impact of cultural differences on public policies and social behavior. The methodology used regards a comparative and a multidisciplinary approach.

Local government bodies and the compression of freedom of religion: the ban on the face veil.

ABSTRACT: During the last decade several Italian local government bodies (and especially Municipalities) attempted to introduce a general ban on the so called “face veil” ( niqab or burqa ) through secondary law, in the absence of a national comprehensive policy on the matter. The aforementioned attempts were, without fail, found illegal by the Council of State and the Constitutional Court. Nonetheless, following the rekindling of the anti-Islamic sentiment in Europe in the aftermath of the 2015 terrorist attacks in Paris, we are currently witnessing a “new wave” of local regulation trying to impose a ban on the face veil, based on the claim that, in order to answer the exacerbation of the so called “clash of cultures”, a different balancing of the fundamental rights involved is needed. The author challenges the legality of the new local bans, as well as the compatibility of a general ban on the face veil with the Italian constitutional system.

“A chiare lettere” – Transizioni • La farsa del burqini: ma c’è un giudice a Parigi! (di g.c.) - di Giuseppe Casuscelli

Nei giorni dello sgomento, del lutto per le atrocità degli attentati terroristici, le ordinanze sindacali sul divieto d’indossare il burqini sulle spiagge francesi hanno avuto il sapore penoso di una farsa fuori luogo, che ha alimentato un “dibattito surrealista” sulla laicità “balneare”. Quei divieti di carattere assoluto sono parsi una ripicca inappropriata, inutile se non dannosa: in questi casi, certo, non era in gioco la necessità di salvaguardare le esigenze fondamentali del “vivre ensemble”, regola derogatoria della libertà di abbigliamento individuata dalla Corte europea dei diritti dell’uomo nella decisione della Grande Chambre nel caso S.A.S. c. France del 1° luglio 2014 con riferimento all’uso nello spazio pubblico del burqa, che copre l’intero volto. Quei divieti, si legge in un comunicato dell’Onu, “non rafforzano la sicurezza ma, al contrario, alimentano intolleranza religiosa e discriminazione dei musulmani in Francia, in particolare le donne. La parità di genere non si ottiene regolamentando i vestiti che le donne decidono di portare”.

Marks on the body and wounds in the soul. The manipulation of the children's genital organs and violated rights

ABSTRACT : Females’ genital mutilation (FGM) comprises any alteration of the external female genitalia , for non-medical reasons. The practice has negative effects on the health and is a violation of human rights of girls and women. In Italy, according to the art. 583 bis Penal Code, any form of FGM is forbidden, including clitoridectomy, excision, infibulation and any other practice causing similar effects, or causing physical or mental disease. Conversely, male ritual circumcision is allowed. According to the author of this paper, genital manipulation practices on both sexes should be explicitly fought and they should be replaced with symbolic actions, in order to protect the minor’s body and soul.

ABSTRACT: This work aims to highlight the obstacles of the social, political, economic and financial exclusion of the European Muslims in order to present eventual inclusive solutions. In Europe the Islamic presence is growing because of two main reasons: the immigration fluxes from Asia and from the Islamic Mediterranean countries and the high birth rates of the European Muslim families. Even if part of the European culture presents several features deriving from the Islamic heritage and even if the national and EU legislations present anti-discrimination laws and specific protections for religious freedom, the Muslims have been socially excluded. Furthermore, Islamophobia has been increasing since 9/11 and especially in the recent months after the jihadist attacks in Paris and Brussels. This feeling increased the exception of Muslims from the public and private life in the European countries. Because of these reasons nowadays it is necessary to improve the available normative tools and, at the same time, it seems crucial to adopt a multidisciplinary method that should involve the Islamic banking, that is fundamental for the development of the Islamic European entrepreneurs, or the halal marketing which considers religion as a new/old variable for the microsegmentation of the European market.

Muslim Organisations in Italy: perspectives on an Agreement with the State

ABSTRACT: This paper examines the legal framework of Muslim communities in Italy in order to check the requirements needed to reach an agreement with the State, as envisaged by the Italian Constitution for denominations other than Catholicism, whose relations with the State “are regulated by law, based on agreements with their respective representatives” (Art. 8, co. 3, Const.). Nowadays the problem is a key issue in current political debates both in Italy and in most European countries. This type of agreement could not only promote the social and cultural integration of Muslim communities into society, but also help isolate Islamic terrorists and their supporters in immigrate communities and fight them better. Given that in Italy Muslim communities and their members, including foreign ones, already enjoy all the civil and social rights that are granted by the Constitution to citizens and social groups, the analysis maintains that reaching such an agreement would be for the moment premature, on the basis of a number of reasons. Among these are the following: the deep divisions existing both within and among these communities, due to different ethnic and religious origins and settlement periods in Italy; the difficulty on behalf of the State to identify a reliable negotiating partner (or more than one) who really represents such communities and does not depend from foreign States. Last but not least the very nature of such an agreement appears to be questionable. In fact, on one hand it would bring relevant advantages and public funding but on the other it would also need an unconditional acceptance of human rights and of the fundamental principles of the Italian law system - among which the equality between men and women and State secularism - which still has to be fully acknowledged within these communities.

The return of waqf

ABSTRACT: The essay reconstruct role and structure of the waqf , typical institution of Islamic law, by a comparison of it with the “ causae piae”, to highlight the concordances and differences, emphasizing the institution's use in the management of the charity and of places of worship in the Muslim ambit, in particular mosques and activities related to them. Particular attention is paid to the activities with social purposes for the realization of the Islamic Welfare, operated by religious communities, with believers support (public waqf ). Frequent are the references to the charity structure in the Anglo-Saxon law. The Autor envisages the opportunity to a number of agreements with the various components of Islam, in which specific parts can find a place, dedicated to waqf as entity inspired by religious reasons, and a review of the general favorable legislation ensured by the State to all religious bodies, and to those who carry out social activities obtaining profit.

Finally reports the rules of the Italian civil law on the subject and in those concerned with private international law.

Economia della spiritualità – economia della politicità (Benedetto XVI: quali riflessi sul post-Concilio?) - di Piero Bellini

Come di prammatica – nei nostri ultimi incontri – è prendere l’avvio (vuoi che la si elogi, vuoi che la si critichi) dalla solita lectio magistralis tenuta a Ratisbona da Papa Benedetto XVI. Soprattutto ha impressionato il drastico giudizio pronunciato – per bocca d’un tardo Imperatore bizantino – sulla negatività senza rimedio della esperienza storica dell’Islam guidata da una píetas disumana. Avrebbe potuto il Papa preferire richiamarsi a qualche testimonial culturalmente più qualificato: a un San Bernardo – per esempio – se non fosse che il De laude novae militiae neppur esso grandeggia in fatto di riguardoso  rispetto verso gli altri. E avrebbe potuto riferirsi alle innumerevoli denuncie prelatizie della smodata ferocia saracena, tese peraltro a confortare a loro volta i milites christiani nell’esercizio meticoloso d’altrettanta efferatezza. Ma forse il Papa avrebbe fatto meglio a richiamarsi a testimonianze cristiane d’altro segno. (continua)

ABSTRACT: An employer refusing to hire an applicant (or discharging an employee) wearing an Islamic headscarf, because of the individual’s religious practice, could be seen as a case of discrimination based on religion and therefore contrary to Council Directive 78/2000/EC of 27 November 2000, establishing a general framework for equal treatment in employment and occupation . However, Article 4(1) of this Directive provides that a difference in treatment based on a characteristic related to the listed grounds of discrimination may not be discriminatory if a particular religion or belief is a genuine occupational requirements for the post. The article examines the question referred at the Court of Justice of the European Union from the Cour de cassation (France) on 24 April 2015: “Must Article 4(1) … be interpreted as meaning that the wish of a customer of an information technology consulting company no longer to have the information technology services of that company provided by an employee, a design engineer, wearing an Islamic headscarf, is a genuine and determining occupational requirement, by reason of the nature of the particular occupational activities concerned or of the context in which they are carried out?”

Nei giorni scorsi ho firmato un appello di questa Rivista dopo i fatti di Parigi (non fra i primi, anzi il mio nome chiude l’elenco degli aderenti, venendo dopo quello di tanti autorevoli colleghi e colleghe, ma unicamente perché ne ho letto il testo e ho quindi inviato la mia adesione solo quando esso recava già molte firme in calce a suo corredo). Spero che la benevolenza del Direttore - tante volte dimostratami in passato, al di là dei miei reali meriti - mi consenta una breve postilla personale, non già perché debba pentirmi di quanto ho fatto (e di cui resto convinto), ma unicamente per circostanziare il senso di una sottoscrizione, che da sola non può riassumere un giudizio articolato; né chiederei un piccolo spazio ulteriore di attenzione, se non fossi convinto che il tema che sollevo merita un più ampio dibattito. 1 - Tutti più o meno conveniamo nel riporre le radici più profonde del lai­cismo liberale nell’«anti-dogmatismo» che gli è consustanziale. Risulta – l’«idea di laicità» – dalla attitudine critica (e polemica) della fi­losofia razionalistica [quella del «Secolo dei Lumi»] verso qualunque asseverazione categorica che intenda riferire ai «sommi valori dello spirito» –  o all’«intima essenza delle cose» – o questo o quel «giudizio di certezza». Impugnano – invero – i Philosophes la perentorietà assiomatica delle grandi Confessioni storiche. Con­testano la presunzione di coloro che se ne sentono partecipi: di poter rifarsi a «verità assolute» [«oggettive», «universali»] del tutto indubitabili. Con l’incentrare la propria riflessione sul principio della «soggettività della coscienza» e del «sapere», i Philosophes vogliono invece risvegliare una reazione della umana in­telligenza avverso la categoricità di tali assiomi: i quali [per il loro medesimo accamparsi siccome «non controvertibili»] tolgono spazio alla creatività libera e piena che – per diritto nativo – s’appartiene alla inventiva vigile degli uomini. ABSTRACT: In Italy imams are more than 800 members. As imams, they are almost all self-taught people. As citizens, most of the times they have a precarious job. During the week, they normally take care of things other than religion. They perform religious functions in their spare time. Moreover, to see them working as imams, you have to go down in some underground parking or in apartments converted into mosques, where sometimes you see minaret and other Islamic symbols, but only in either the picture or in the paintings hanging on the wall. In the end of the day, we know little or almost nothing about imams. Besides, the Italian law normally do not recognise them as religious authorities. Nevertheless, as imams they play a very important role in local Muslim communities that, under the pressing process of immigration, hold nowadays more than two millions persons. The paper will analyse the status of Islamic imams in Italy, comparing them with the status of other religious authorities (priests, rabbis, pastors ecc.). In particular, this comparative perspective will be focused on both angles: on the one hand, the research will compare the role of imams with those of religious authorities within their respective community; on the other, we will compare imams with considered the different way through which Italian law treats both imams and other religious authority . This perspective will give us a possibility to underline how both the social context and the Italian legal framework (regulating the State-religions connexions) manage religious claims.

“A chiare lettere” - Charlie Hebdo - di Giuseppe Casuscelli

La rivista Charlie Hebdo è familiare agli studiosi dei rapporti tra Stato e confessioni religiose da quando nel 2005 decise di ripubblicare le vignette su Maometto con un coraggioso gesto di solidarietà verso i colleghi del quotidiano danese “Jyllands-Posten”, che per quella pubblicazione avevano subito un attentato incendiario della loro sede. D’allora non ha mancato di levarsi qualche voce ammonitrice sui pericoli dell’imprudenza e anche di una qualche islamofobia, che si andava ravvisando nella linea del giornale. Ma, al di là di alcune scompostezze tipiche della satira (che non hanno risparmiato neppure il papa), emblematica di quella linea è la recente vignetta, in cui Dio punta con il dito un musulmano armato di bastone, ricordandogli che “ Allah est assez grand pour défendre Mahomet tout seul … Compris? ”: ecco, espresso nel genere letterario della satira, ciò che in termini giuridici insegniamo nelle nostre università sui fondamentalismi religiosi che, all’insegna di un Dio che è solo con noi, minano alla base la convivenza pluralistica delle nostre società. ABSTRACT: The present work deals with the issue concerning the protection of the right to religious freedom in Egypt, on the basis of the fact that the Constitutions of this Country, following the Sadat era to the present day, while recognizing the essential elements of constitutionalism, attach to Sharia principles the rank of preeminent source of legislation. On the basis of this specificity, therefore, this work examines the relationship between Islamic culture and constitutionalism, focusing on a number of judgments of the Constitutional Court, known for having permitted a more liberal interpretation of the Sharia rules. Just the particular method used by constitutional judges in order to establish the principles of a religious nature that can not be violated by the legislature, in fact, offers starting points about the future, possible cohabitation, or contamination between the two cultures mentioned, with interesting implications on the subject of religious freedom.

The crime of honor and the aggravating factor of the trivial reasons' culturally (and religiously) motivated

ABSTRACT: A recent case law of the Italian Court of Cassation, on 2013, ruled that, in the case of the attempted murder of a daughter, trivial reasons cannot be considered based on the honor of the family and the violation of a fundamental religious precept. The evaluation of these cases then relates to that, of a much broader scope, linked to the concept of 'cultural crimes' or cultural defence. It is necessary, however, to perform a careful balancing between guilt and offensiveness proportion on the one hand and, on the other hand, to consider the extent to which the author of a culturally motivated crime can enjoy a punitive treatment, though attenuated compared to those who commit the same crime without a cultural motivation. A judgment intrinsically linked to a cultural and ethical relativism, cannot be accepted that though respecting the multiculturalism of the western society in general, and of the Italian one in particular, must always find its legitimacy by submitting to the principles and values on which the Italian Constitution is founded.

ABSTRACT: The French Law no. 2010-1192 of 11 October 2010, introduced the ban on wearing clothing designed to conceal one’s face in public places. Muslim women do not have the possibility of wearing the full-face veil ( burqa / niqab ) in public. The present article explores the question concerning whether the burqa ban is compatible with the democratic society in Europe and particularly with Article 9 of the European Convention of Human Rights, which guarantees the exercise of freedom of thought, conscience and religion. To do so, the paper critically analyzes a recent decision of the Strasbourg Court, S.A.S. v. France of July, the 1 st 2014. The Court held that the barrier raised against others by a veil concealing the face can be perceived as breaching the right of others to live in a space of socialisation which makes living together easier. The Author examines the issue considering various features of secularism and their effects on the different points of view regarding religious freedom.

Plural Islam in Albania: patterns of relationship with the state and religious peace

ABASTRACT: The protection of individual and collective freedom of religion and freedom of conscience, the regulation of state relations with religious communities in Albania, have found a solution in peculiar legal rules and traditions that in the history of the Albanian people have guaranteed the religious peace. Of great significance was the Albanian legal system resistance to accept the advice of the Venice Commission, Council of Europe and the EU that would rather prefer and have sought to impose the adoption of a single political-legal model for the Balkans, focused on a general law for the protection of religious freedom. Albanian model dates back to 1923, recognizes the cultural and religious pluralism of society and the opportunity for all religious communities to obtain
civil legal personality, now allows cooperation agreements with the various religious communities. The rules put as guarantees of religious freedom those of the general law without any recourse to special rules. What happened was possible because of the plural nature of Balkan Islam which has allowed mutual respect and tolerance, and thanks to the secular and separatist nature of the
Albanian state since its origins. State law likewise religious rules, determined by the Statutes that communities have been given themselves and their progressive transformation have played a role in education for coexistence which has allowed, in contrast to
what happened in many Balkan countries, religious peace. The smaller denominations and cults have found, and find now, legal
protection, and at present are five the creeds that have concluded agreements with the state and others may do so in the future. The success of the Albanian model warns against standardization policies, substantially octroyé, supported by international bodies end one size fits all legal model/pattern.

Where religious freedom is heading: common paths on both sides of the Mediterranean

ABSTRACT : The paper aims to investigate the path of religious freedom on the two sides of the Mediterranean. Assuming the possibility of a synoptic history, the paper observes this synopsis from three different perspectives: historical, political and pluralistic. Taking the Declaration of Universal Human Rights as a common parameter for the two sides, the paper analyzes the contemporary process of politicization of the right of religious freedom both in Europe and in the MENA countries. Stressing the fact that the core of this right has to be individuated into the autonomy from the state of both (religious) individuals and communities, the paper advocates a defense of religious freedom as an autonomous and specific right, not completely merged with the generic protection of freedom of conscience and with the goals of the states. This kind of conflation, in fact, could subvert the fundamental distinction between religious and civil spheres, with harmful consequences for both the state and religious communities.

ABSTRACT: Religious freedom within Europe and the place of Islam within Europe are of particular contemporary interest. The focus of recent case law developed by the European Court of Human Rights (ECtHR) has been on national laws which proscribe the wearing of religious symbols in certain aspects of the public sphere, and on the claims more generally to religious and cultural freedom of Muslim minorities in European states. Stepping back from these cases, this Article aims at a theoretical analysis of the subject, involving the contrast between value pluralism as a basis for religious freedom in international law, and other fundamental rights, i.e. women’s or children’s rights. By recognizing the intrinsic connection between individual rights and communal goods, value pluralism opens new pathways for enforcing human rights.

ABSTRACT: The constitution in the European legal space of a stable islamic community has given rise to a series of repercussions in the legal regulations of all countries of the European Union. Governments, Parliaments and civil society have been called to assess the requests made by the muslim associations, in order to give recognition to a specific set of rules and habits, which is variably understood by Muslims themselves as necessary to live in a manner consistent with religion. This, however, on the one hand, has imposed to the State institutions to reflect on the coexistence of concepts such as the universality of rights, the respect for cultural distinctiveness and the centrality of the principle of secularism in all the national legal orders, and, on the other side, has urged the muslim communities - considered as a complex and articulated whole - to put in place an attitude of moderation and adaptation towards the foundational principles of the Western legal world .

ABSTRACT: In Italy many places of worship avoid the scope of planning regulations. This situation, especially for the places of Islamic worship (musalla), sometimes arises from the suspicion of local authorities to grant adequate space for the realization of these places; it sometimes arises also from the choice of the religious confessions. Therefore we face a difficult situation: you must guarantee the right to the free exercise of worship of the faithful in the area and at the same time you must comply with the provisions relating to urban planning, to protect other community needs, such as security or public order of the places.

Migrations and laicity of the law in the polis euro-Mediterranean

ABSTRACT:
The recent increase in migration flows to Europe and the tumultuous popular uprisings in North Africa and the Middle East (so-called Arab Spring) are creating significant problems of coexistence between different cultures and religions throughout the euro-Mediterranean area. Leveraging on new cultural and legal turmoil of the moderate part of the Islam and on the revaluation of the plural open and inclusive identity of the Old Continent, it is hoped the use of a procedural laicity at the entire polis euro-Mediterranean, for bring near both sides of the Mare Nostrum with intercultural dialogue and prevent the worsening of the clash of civilizations: the North Christian and the Muslim South. We propose, therefore, are some tips to overcome the tensions on religious freedom in the new geopolitical balance and for make collaborate with institutions, in a democratic and transparent mode, communities and religious and ethical groups in an attempt to reach a wider area of integration euro-Mediterranean, whose legal system, spreading better peace and social justice, would create more adequate conditions for the protection of inalienable human dignity.

ABSTRACT: During the long history of the Western Legal System, Christian religion has been playing a key role in defining some of the pillars of modern constitutionalism. This is evident in respect to important constitutional principles like, for example, the notion of “person”, as established in the article 6 of the 1948 Universal Declaration of Human Rights (“Everyone has the right to recognition everywhere as a person before the law”). At the same time, some theological notions of medieval constitutional thought represented the political pedestal of the absolute sovereignty of the State, which is antithetical to the logic of constitutional legal system. With this article, the Author analyses the way some theological notions of Christianity have been “secularized” – and then “codified” – in the Western constitutional States, influencing the pillars of contemporary democracies. This could explain, for example, why the legal instruments carrying out the relationship State-Churches in certain Western democracies do not work very well as they did in the past. In fact, from time to time, these instruments have been able to create the conditions for a proper interaction – an  “overlapping consensus”  – between religious groups and public authorities as well as an acceptable balance between universal principles of Western constitutionalism and ethnic-cultural-religious differences. Nowadays, however, these same instruments seem to fail. Precisely because immigration and today’s multicultural societies see masses of people that come to Western Countries with their religious identities and, sometimes, with a global perspective which complicates the century old tension  between universal principles – launched by the history of the Western constitutionalism – and the current cultural-religious belongings.

ABSTRACT: The article is aimed at presenting briefly the actual legal regulation of protection of the religious rights of the individuals belonging to the Muslim and the Jewish communities in Bulgaria. The author has tried to combine the legal issues with some recent sociological studies on Anti-Semitism and Islamophobia and the related violence and crimes. The phenomena Anti-Semitism and Islamophobia are based on the presence of Muslim and Jewish communities in Bulgaria. The article gives some recent statistical data on Turks (Muslims) and Jews in the country according to the last census in 2011. The focus of the study is on the domestic legislation, especially the political rights, the protection against discrimination, the notion of “positive discrimination”, the religious rights and freedoms and the relevant Bulgarian criminal law. This legal regulation is analyzed in the light of Art. 5, Para. 4 of the Bulgarian Constitution which stipulates the primacy of the obligations under the International Public Law. Some relevant case-law is quoted. The legal analysis demonstrates the fact that there are no legal definitions of “Anti-Semitism” and “Islamophobia”. A general conclusion is drawn about the compatibility of the Bulgarian system for protection of individuals that belong to minorities with the international obligations.
