The collective projections of religious freedom

ABSTRACT: This paper investigates new perspectives on religious freedom in Italy. Many issues on religious freedom are on environment protection, religious organizations, heritage on holy places and privacy protection. Especially, the focus is real dimension on relationship between State and churches in the Constitutional statement of Italian Republic.

The delicate constitutional Balance between Freedom of Speech and the Protection of religious Sentiment: comparative Profiles

ABSTRACT: The article focuses on the issue of freedom of speech and freedom of religion from the point of view of two countries with specific legislation in place (Pakistan and Germany). In particular, we will examine the two Constitutions and the two Criminal Law, which proved to have very different ways of expressing their sensitivity and a great attention to the religious sentiment of the population.

Religion and healing: religious freedom and the principle of self-determination in matters of mental health (Salus aegroti suprema lex o voluntas aegroti suprema

ABSTRACT: The case before the Court of Strasbourg, projects us into the most sacred and private dimension of the life of the human being: that of religious options. In the present case, a young woman with behavioral disorders, manifested even before joining the group close to the Movement founded by the Indian Master Osho, following undergoes a series of medical treatments obligatory that force her to the suspension of the religious practices to which she usually devotes for her own psychophysical well-being. But according to the opinion of the doctors these practices compromised the applicant's mental health status, representing a serious and ascertained danger. The doctor becoming the promoter of his patient's health, ends up interfering in the personal sphere of the girl's religious sentiment, trying to modify the choices deemed to be non-conforming to tradition and prejudicial to health, without scientific evidence and, exclusively, on basis of presumptions and religious prejudices. The facts give rise to some considerations on the methods and criteria for balancing the protection of the right to health, and self-determination in therapeutic choices, and the exercise of religious freedom in conditions of compromised mental health, and the risk of a reviving confessional in Lithuania.

The free exercise of Religion in People’s Republic of China

ABSTRACT: After some historical reflections on the spread of multiple religious doctrines on the Chinese territory between the end of the XIX and the beginning of the XX century, the Author considers the attitude of the central government with respect to the right of religious freedom from the time of the Cultural Revolution to today, paying particular attention to the constitutional and criminal law provisions attached to this issue. It seems clear how the Chinese legal tradition is not based on a balance of interest theory as known in the Western legal systems, given the prevalence of the higher communist principles rooted in time. Last pages are reserved for the systematic violations of human rights reported by numerous international observatories, as well as the ancient grudge between China and the Holy See caused by the question of the appointment and formal recognition of new bishops. The provisional agreement signed on 22 September 2018, while marking a step towards finding a solution to this tensions, doesn’t offer a definitive solution to the problem.

Religious hate speech, freedom of religion and freedom of expression. Reshaping the rights in the multicultural societies

ABSTRACT: In the multicultural societies, lawyers are more and more often engaged in identifing useful tools to solve the rising conflicts between fundamental rights. The exercise of freedom of religion and freedom of expression can led into this kind of phenomena that could be taken into consideration by law, like hate speech and religious hate speech. The paper tries to approach two particular form of hate speech, the political and the religious one, to check if some alternative models of protection could be implemented to assure an effective protection of minorities without any sacrifice of individual fundamental rights.

The legal framework of the italian Jewish communities in the first decade of Italy’s unification

ABSTRACT: The essay deals with the unification of the normative structures of the Italian Jewish communities after the Unity, by reconstructing the extensive debate that took place in the Jewish context. It then analyzes the legislative proposal of extending Rattazzi's law of 1857 to the entire national territory, which was presented by the Italian government to the Parliament in 1865. Finally, it gives an account, through a vast and largely unpublished archival documentation, both of the choice of individual communities to maintain the legal systems in force in the pre-unitary italian States, and of the attempts, advanced in the parliamentary center between the end of the nineteenth and the beginning of the twentieth century, of abrogation of the Rattazzi's law, considered, due to its jurisdictional traits, in contrast to the principles of the liberal State.

Quo Vadis: A Narrative of the Time of Nero. The Power of the Words

ABSTRACT: Set during the reign of the emperor Nero, Quo Vadis tells the story of the love that develops between a young Christian woman and a Roman officer who, after meeting her fellow Christians, converts to her religion. Underlying their relationship, the novel becomes a good stratagem to emphasize the contrast between the worldly opulence of the Roman Empire and the poverty and spiritual power of the Christians, whose concepts would play a crucial role during the long history of the Western Legal System. With this paper the Author tries to explain how important a novel like Quo Vadis could be in order to better understand the strong impact of the Christian tradition on the history of Western constitutionalism.

Legal features of the sacred in pluralist systems. Recent developments in the Canadian constitutional legal order

ABSTRACT: Nowadays the concept of "sacred" is characterised by a pluralization of the religious phenomena, which are barely defined from a legal point of view by the State. One of the criticalities of this scenario lies in the fact that there is no uniqueness on the limits that the State determines in outlining the boundaries of a religion. The risk of this lack of precise limits could be, inter alia, the offense to religious sentiment. The Author investigates the legal provisions that limit offences to religious sentiment such as the crime of hate speech and blasphemy in Canada. The latter is in fact a pluralist system considered as a good example for other States.

Health Treatments, Right to Self-determination and End-of-life Choices after Constitutional Court Ordinance No. 207/2018

ABSTRACT: The present essay deals with the issue regarding end-of-life choices after Italian Constitutional Court ruling No. 207/2018, which has prefigured, in certain exceptional situations, the partial unconstitutionality of the provision prohibiting aid to suicide (Article 580 of the Italian Criminal Code). The Author stresses that the patient’s right to refuse or interrupt life-saving treatment can be deemed to be protected by the Constitution, while the enactment of a right to assisted suicide into Italian law would require an ethical choice, which should instead be left to the discretionary assessment of the lawmakers.

Procedural novelties regarding marriage nullity and canonical jurisdiction

ABSTRACT: The purpose of the essay is to investigate the changes made to the discipline of the canonical process of marriage nullity by the Motu Proprio “Mitis Iudex Dominus Iesus”, in an attempt to verify whether the reform - which, as we know, has foreseen, among the other novelties, a shorter trial before the Bishop, and the elimination of the double sentence in conformity - both in line with the imprint proper to the canonical jurisdiction. In this perspective, the study will be dedicated to the historical reconstruction of the Processus brevior coram Episcopo and of the institute of the c.d. double sentence in conformity, at the end of which it seems possible to point out that the devolution to the Bishop of a shorter judgment - and the consequent reduction of the procedural forms - should not have undermined the cardinal principles of canonical jurisdiction.

Νόμοσ e συνεἱδησiς: dall’Antigone di Sofocle all’ordinamento canonico

SOMMARIO: 1. Perché Antigone: la tragedia di Sofocle come paradigma per ricostruire il rapporto tra legge e coscienza nel diritto canonico - 2. La dinamica degli opposti tra dimensione giuridica e dimensione politica. Perenne attualità di tale dinamica. In particolare: a) Il contrasto tra lex e ius. Reflections on marriage nullity proceedings in the context of the Italian exequatur procedure

ABSTRACT: The obligation to request the exequatur of the ecclesiastical sentence of marriage nullity, foreseen by the art. 60 of the General decree on the canonical matrimony of the CEI, constitutes in Italy a legal duty for the faithful who determines, for judges and lawyers, a corresponding moral duty (but which for lawyers can also become legal, under the professional mandate) of collaboration, during the various prejudicial and judicial phases of the canonical proceedings, in acquiring and making available all the useful elements in view of a exequatur procedure.

Religious-Ethos Employers between European Directive, national laws and Court of Justice EU

ABSTRACT: This article examines two recent rulings of the Court of Justice of the European Union (cases Egenberger and IR). These are the first rulings on art. 4, par. 2, Directive 2000/78/EC on “occupational activities within churches and other public or private organisations the ethos of which is based on religion or belief“. On the one hand the author focuses on the passages concerning religious autonomy and jurisdictional protection of rights; on the other hand she highlights the links between the jurisprudence of the two European courts (CJEU and ECHR) and tries to reconcile the statements of the Court of Justice and those of the German constitutional Court on the limits to the autonomy of churches. However, the article highlights how the Court of Justice has not adequately addressed neither the art. 10 of the European Charter of Fundamental Rights EU, nor the art. 17 of the TFEU. As regards the ideological requirement set by art. 4, par. 2 of the European Directive, the study focuses on the additions made by the Court of Justice and recalls the reinterpretations of the ideological requirement recently adopted by the Catholic and Evangelical Churches in Germany.

Denied identities. Female genital mutilation: the fight of Europe against a silent violence

ABSTRACT: FGM refers to rituals of manipulation female genitalia and other procedures against female genital organs for non-medical reasons. Usually the practice is carried out on young girls, from childhood to teenagers. These rituals are carried out for cultural, religious and social reasons in the mistaken belief that they will produce a benefit to the girl (to safeguard her virginity, to prepare for marriage, etc.). No religious text prescribes the practice, but is rooted in the culture and beliefs of the communities that practice it. However some religious communities practice the FGM. Rituals do not help the health of the girl subjected, but they can lead to serious health complications or even to death of victim. So FGM is recognised a form of child abuse and a violation of women’s human rights. The EU is committed to eliminating FGM through strategic actions and legislative measures, but mainly changes in attitudes and beliefs among relevant communities are important to ensure FGM is abandoned. It is also important to fight FGM with direct involvement of the religious and political leaders of the communities where the rituals are diffuse. European States are called to cooperate with each other with strategic internal and external actions.

Draft law n. 387/18, “Provisions concerning the crucifix exhibition in schools and public administrations”: brief reflections.

ABSTRACT: The draft law n. 387 of March 26, 2018, (obligation to expose the Crucifix in schools and public administrations), is part of a complex legal-constitutional context of relations between state and religious phenomenon, characterized by multiple unresolved issues and problematic profiles. The law refers to the theory of cultural and identity value of the symbol, sustained with continuity by the administrative jurisprudence in disputes concerning the regulations governing the exposure of the crucifix. The questionability of this hermeneutical perspective, largely outdated, is clear and evident if we consider the most current judgments on the subject. The most critical issues of the current proposal will be examined.

Notes on ritual circumcision in Ecclesiastical and Religious Law.

ABSTRACT: This paper deals with the delicate issue of ritual circumcision in Ecclesiastical and Religious Law. After having investigated the etymological origin of the word and reconstructed the history of the practice in question – distinguishing between circumcisions: a) therapeutic or prophylactic, b) ritual, c) cultural or ethnic – the focus is on the jurisprudential orientations of the Italian Court of Cassation. The solution proposed by the judgment of 24 November 2011, n. 43646, is carefully read and compared with the EU's law, the German legislation and the results of the recent Icelandic debate. Nevertheless, the absence of an ad hoc law on circumcision does not represent a vulnus in the Italian legal system, since the discipline can be found in the positive law in force, and even before in constitutional principles, as interpreted by the jurisprudence of merit and legitimacy. On the contrary, the essay raises the question that the introduction of a law on circumcision would not only be superfluous (for ethical and cultural reasons, even before legal ones), but also late".

The Principle of Legality in the Canonical System and the Approach to Penal Law

In this article, the Author examines the principle of legality and its expression in the canonical system and in canonical penal law in particular. Opening with a reflection on the origins of the principle of legality in its ecclesiological context of the Church as a community of the faithful, the article then treats the principle of legality in its relation to the three powers of governance - administrative, legislative, judicial - and an essential aspect inherent to the exercise of each, namely discretionality, rationality, and moral certitude, in light of canonical penal law. The article closes with a brief mention of the principle of episcopal collegiality in light of the principle of legality.

Canon property law issues. Some thoughts around the obligations arising from the new Italian Third Sector law

ABSTRACT: The new Italian law in the field of the Third Sector provides for some burden on civilly recognized religious bodies, among which there are also Catholic ecclesiastical bodies. This paper deals with the canonical consequences of these obligations related to the general principles of Church law, as they are stated in the Code of Canon Law and the particular Italian canon law. The fulfillment of these government obligations is obviously not mandatory, however in many cases it may be timely, especially for institutions that already enjoy tax benefits that they could lose if they did not comply with the deadlines established by this new Italian law. Nevertheless, the central question is to verify whether certain obligations are lawful according to the Canon law. The essay raises the question of the provision of an “earmarked stock” and “internal rules” additional to their canonical Statutes, and especially the canonic assessment of commercial activities. If it is true that one has the right to do anything, but not everything is beneficial or constructive, catholic religious bodies should mind some questions before deciding to follow this law.

ABSTRACT: Many scholars identify a strong analogy between art. 116, c. 3 (dedicated to the differentiation in the autonomy of the ordinary statute Regions), and art. 8, c. 3 (dedicated to the relationships between the State and the religious denominations different from the Catholic one) of the Italian Constitution. The paper deals with this opinion to underline the importance of the ecclesiastical law (of the State) in order to analyze the doubtful impact of regional autonomy on the equal safeguard of constitutional rights and liberties (first of all, the religious freedom).

Observations about the genocide: hypotheses of comparison and consequences on the legal protection of religious freedom

ABSTRACT: Talking about the genocide implies to recall a wide doctrinal processing, including refined strategies to put into effects the legal definition of genocide itself. This conceptual effort should combine the historical reconstruction with a dramatic but intransigent analysis of the most recent massacres. The constant presence of religious conflicts in concrete representations of genocide undoubtedly shows how the stance for religious freedom shall be definitely urgent and participated, because genocides are a maybe surprising but anyway unquestionable part of our most recent legal history and systems, including the institutional development of the European Union.

Specificity of canonical administrative law and “mission administration”. Ecclesial ministry as a requalification marker for  ontological-disciplinary autonomy

ABSTRACT: The need to configure a correct boundary within which to draw up the structure of administrative activity in the Church responds to the urgency to avoid undue and inaccurate transposition of concepts proper to secular juridical fields in the background of Canon law. In fact, in the Church it is not possible to speak of a "public administration-entity" but of an "administration-activity". It is not so much the subject that has to be examined, in view of a claim that is not suited to the foundational (top-down) and non-consociative (bottom-up) nature of the Church; as much as the concrete activities to be carried out within it, in the ideal of a shared responsibility that does not deprive the individual faithful of juridical positions that they can claim, but directs them within correct coordinates. The faithful do not live a dimension of "homo homini lupus", to reach an individual salvific finish line where one place to be conquered excludes that one of another. On the contrary, they pursue, united under the one baptism, the implementation of the mission of Christ, also through those juridical instruments which the Church has endowed through the story, but which are to be understood in their precise peculiarities, even though a relationship can not be excluded of mutual growth with secular law. According to this paradigm, the example of European Union law can be a valid benchmark for describing the particularities of ecclesial reality in a sector as specific as that of administrative law.

Confessions and religious communities in Eastern Europe, religious pluralism and legislative policies of the States

ABSTRACT: The intervention reconstructs the supporting lines of the activity of the national office of each legal system in charge with the maintenance of the relations between the State and the confessions and religious communities in the Eastern European countries. Through this perspective, the ecclesiastical politics of 19 countries is reconstructed, highlighting the genesis and the peculiar characteristics of their legislations and highlighting the underlying lines that are at the root of the choices of their systems. Particular attention is dedicated to the definition of the different models to which the States refer in relation to their effectiveness in maintaining religious peace while respecting the principle of equality and freedom among the various religious confessions. The article aims to be a contribution to the development of guidelines for relations between the state and religious confessions in Europe.

Towards a new philosophical dialogue between profane and religious

ABSTRACT: Christian religious philosophy builts itself from a very precise idea of the mortality whose time cannot as such manifest the truth of human being. Profane philosophy, we are in the eighteenth century, Enlightenment, asserts itself as the antithesis of such construction. Truth of human being belongs exclusively to his mortality, that is to say a determination of time. Everything becomes “history”, in other words, truth of a temporality of which the Reason is reappropriated. Here is the primary sense of the Reason of Enlightenment. This article is a critical interrogation about this pure methodological question.

Educational Institutions in the Italian Constitution

ABSTRACT: According to the current Constitution, Italy presents itself as a pluralist and participatory democracy, in which certain functions aimed at enhancing the human person are not taken directly by the State – except in exceptional cases in which the public authorities intervene, for reasons of necessity, in a subsidiary or supplementary way – but they are normally assigned to specific social subjects (or formations), among which the educational institutions have a special and qualified position. The present contribution intends to highlight that the Italian “social State” does not present itself as a “educating State” in its own educational models that the public structures impose in an authoritarian way on the single components of the national collectivity. On the other hand, the Italian Constitution, in recognizing social relevance to the educational function, assigns its concrete management to certain “"pedagogical agencies” or “educational institutions” operating autonomously within the civil society: among which the qualified family holds a qualified position. School and religious confessions. They do not operate in the name or on behalf of the State, but operate within a framework of legal, cultural and institutional guarantees and pluralism, within a normative framework dictated in this regard by the constitutional text and by ordinary legislation. By carrying out the special role assigned to them by the Italian legal system, educational institutions participate in the democratic dynamics of the country, contributing with their work to the construction and evolution of the civil and national community.

The autocephaly of the Ukrainian Orthodox Church, doctrinal interpretations and ecclesial structures in comparison

ABSTRACT: The granting of the autocephaly to the Ukrainian Orthodox Church has provoked much controversy both with regard to the authority authorized to grant, both regarding the requesting church, and with regard to the involvement of other Orthodox churches with jurisdiction in that territory. In the absence of specific legislation, I took into account the modalities related to the previous concessions and to the subsequent recognition by the other autocephalous churches. The claimed jurisdiction of Constantinople on Ukrainian territory and the objections in law and in fact by the Russian church have been highlighted. From last an indication to the content of the tomos of “autocefalia” and the rights that the ecumenical patriarch is reserved.

Dworkin’s Atheistic Religion and the Divinization of Value

ABSTRACT: This essay critically discusses some of the central ideas of Ronald Dworkin’s last book, Religion Without God. In particular, it will be argued that the idea of “religion without God” is not a form of atheism, as Dworkin claims, but a pure religious attitude in which the idea of “theistic entity” of traditional religion is replaced by a new and not less problematic entity, the idea of “value”.

L’Europa di chi non crede

Son passati quasi trent’anni dacché tra le varie dichiarazioni apposte in calce al trattato di Maastricht comparve abbastanza inaspettatamente quella che impegna l’Unione Europea al “dialogo trasparente, costante e regolare” con “le chiese e le associazioni o comunità religiose” non più e non meno, tuttavia, che con le “organizzazioni filosofiche e non confessionali”. Dichiarazione apparentemente innocua, giacché espressamente si esclude che da essa possa essere pregiudicato lo status a quelle organizzazioni assegnato dai diritti nazionali, ma politicamente impegnativa per l’Unione, tanto che fece strada e si riversò nell’art. 17 del TFUE, assumendo così un carattere anche giuridicamente impegnativo. Non-believer’s Europe

ABSTRACT: In spite of the Treaty on the Functioning of the European Union, which puts on the same footing the status of the churches and of the humanist organizations, the status  of believers and non-believers is not the same in each state, regardless its model (the paper quotes briefly the features of United Kingdom, France, Belgium, Italy, Germany  and Malta). The reason lies in a kind of mass religious tradition, which at present is even more hard to defeat because of the rampant populism, which takes advantage also of the religion. The antidote stays in the pluralistic – not monist and excluding the differences -  secularism in order to grant the same dignity of believers also to both differently believers and non-believers.

Dignitas connubii and marriages of Non-Catholics. An achievement to be maintained, improved and complemented

Abstract: The instruction Dignitas connubii of 2005, Art 2-4, deals with marriages, in which one or both parts are non-Catholic - whether baptized or not. This is a great progress initiated by the Second Vatican Council, even if there still are some omissions and ambiguities in the regulations. Since 2005, some jurisprudential experience could be gained and further official documents concerning non-Catholic marriages have been issued. They are mainly dealing with Orthodox Christians and are dedicated to the recognition of matrimonial sentences, the determination of formal defects and competence issues. Mitis iudex does not mention anything concerning this topic but in case a new instruction should be made now, the named Articles would have to be maintained, improved and complemented.

Collective religious freedom and principle of non-discrimination in the ‘constitutional’ system of the European Union

ABSTRACT: In the two recently handed down Judgments in the cases Vera Egenberger and JQ, the Court of Justice of the European Union for the first time interpreted Article 4, par. 2 of the Anti-discrimination Framework Directive (Directive 2000/78/EC) admitting a ‘religious exemption’ in favour of Churches and other religious organisation, and ruled on the horizontal application of the right not to be discriminated against in situations coming within the scope of EU law. The paper explores the substantive implications of those Judgments for the collective religious freedom and their contribution in clarifying the horizontal direct effect of the fundamental rights and principles enshrined in the Charter of Fundamental Rights of the European Union.

Debating Religious Education in Italian State Schools: the Council of State and the right to choose at any time during the school year

ABSTRACT: The paper starts with some preliminary remarks on the legal framework that regulates religious education in Italian State schools. It then analyzes and comments upon a recent decision taken by the higher administrative court (Council of State) that upheld a previous judgment of a lower court stating the right for the parents of a student to choose whether to take - or to withdraw from - religious education at any time during the school year, and not only at the beginning as provided by law.

Religious dietary rules and school lunch menus: a challenge for secularism?

ABSTRACT: The paper starts from a case of dietary pluralism to discuss the possibility to justify menus sensitive to different religious dietary rules in schools’ canteens. Building on an analysis of the idea of secularism, both in its legal interpretation and in its philosophical understanding in terms of neutrality, I try to show that providing for menus sensitive to different religious dietary rules does not amount to a breach of secularism; it is, rather, a legitimate consequence of the protection of individuals’ rights to freedom of conscience and religion. Moreover, whenever institutions take action to devise and implement such menus they can be taken to act on a commitment to respecting the beliefs of minority groups in society without expecting that these groups, which are often migrant communities suffering of well-known problems of social integration, take on the burden to put forward public claims.

The effects of the legal reform of the Third sector on the Ecclesiastical law (of the State). The case of “cinque per mille”.

ABSTRACT: The article deals with the effects of the Italian Reform of the Third Sector on the Ecclesiastical law of the State and focuses on the peculiar measure of financial aid called “cinque per mille”, as governed by the legislative decree n. 111/2017. The author analyzes some problematic issues involved by this decree and underlines its importance in achieving the goal of a more amply and extended awareness of the today meaning of religious freedom as s well as of the relationships between the State and the Church.

The election of a Catholic priest as Rector of the University of Strasbourg: “Much ado about nothing”?

ABSTRACT: This study examines the question of compatibility between the principle of neutrality of public services in force in French law and the election of a minister of the Catholic religion as Rector of a public university. The Author rules out the existence of any form of incapacity. However, since the duty of discretion of the public official (“devoir de réserve”) operates even outside the exercise of his functions, it may limit the freedom to exercise pastoral ministry in specific cases, as well as the performance of the most typical tasks that are inherent in the status of minister of worship, due to the inevitable repercussions on the image of the university.

Neutrality, diversity and celebration of religious festivities in public schools

Abstract: This paper analyzes some legal conflicts derived from the celebration of religious festivities in ​​the public school. On the one hand, the celebration of certain festivals that, while showing a cultural tradition, at the same time, present a religious meaning, mainly of Christian inspiration. On the other, when permission is requested to celebrate and commemorate such festivities during school hours. Beyond the concrete problem, it is important to start from the position of inclusive neutrality that public authorities must adopt to manage the religious diversity that manifests itself in this specific area and which, in turn, is the best way to guarantee the right of parents to choose the education they wish for their children.

The origins of the Christian fundamentalism: comparative approaches and research perspectives

ABSTRACT: The aim of this essay is to demonstrate the Christian roots of the public discourse concerning fundamentalism, its disciplines, groups and legal consequences. This issue implies to go back to the first Christian fundamentalist experiences born and raised during last two centuries in America (with a peculiar focus on the United States). By reconsidering a wide historical period and a not simple variety of local religious communities, it will be possible to underline a substantial and concurrent beginning for similar movements in the progressive development of Jehovah’s Witnesses, new wave Lutheran and Baptist Churches, Church of Latter Day Saints: some of the same faiths and cults still effecting the American recent ecclesiastical controversies.

The Protestant Influence on the Church Reform of Peter the Great

ABSTRACT: Peter the Great first comes into contact with the outside world through long familiarity with the German Quarter, a fluctuating Muscovite community of foreigners with its Lutheran and Calvinist churches, and with subsequent and extensive travel in the Protestant Lands (1697-1698), where he has ample time to appraise the role of sovereign as head of the church. The relationship of the tsar to his church is paradoxical; on the one hand, it emanates laws contrary to the principles sanctioned by the Church's Councils and organizes blasphemous parodies with The All-Joking, All-Drunken Synod of Fools and Jesters; conversely, he imposes rigidly traditional religious behaviors on the military. Rejecting his role and duty as Servant of the Salvation of Souls, he assumes a secular stance: Protector of the wellbeing of the community, (Vsenarodnaja pol’za). This swerve subordinating Church to sovereign undergoes elaborate scrutiny by Feofan Prokopovyč, apologist and theologian with Protestant leanings, who, in light of the abolition of the Patriarchate and the institution of the Holy Synod, affirms the principle of cuius regio eius et religio, openly challenging the position of the locum tenens Stefan Javors’kyj.

Halal alimentation and the challenges against french laïcité: the request of alternative menu in the school canteens

ABSTRACT: The article will concern the debate about the balance between secularism and religious-driven prerogatives through a narrow focus on the diffusion of halal food in France. In particular, I will shed light on the increasing request of shari'a-compliant food by Muslims in some social spaces, for instance in the school canteens. My research will unfold its arguments in two sections. In the first one, I will address the recent development of halal market in France and try to frame the reasons of such burgeoning activities - revival of Islam or neoliberal marketing strategy? In the second part, I will consider the sentence of Dijon Administrative Tribunal, which in 2017 abolished the decision of the mayor of Chalon-sur-Saône of suppressing halal menu in the school canteens. The verdict might be read as an opinion favourable to Muslim’s prerogatives. Nonetheless, the rationale of the judgement does lie indeed in the defence of the “best interest of the child”, whereas the basic principles of French laicité were not put into discussion.

Belarus in search of its identity and the process of confessionalisation of the State

ABSTRACT: The current piece analyzes the stages characterizing the transition from State socialism to State Confessionalism through the Collaboration Agreement between the Belorussian Government and the Exarcate of the Russian Orthodox Church in Belarus. The main subjects of the agreement and the confessionalisation process of the institutions are taken into account. The essay deals with the alteration of the basic functions of the Belorussian State, namely education, health services and assistancy to the segregating foundations, etc. Furthermore, the agreements with other traditional religious groups are relevant. In this regard, the law on religious freedom is mainly used to resist the spread of such new cults. The study is then finalized to highlight the existing link between the Russian Orthodox Church traditions and cultural heritage with the estabilishment of a national identity. This symbolic bond is then used to build the basis of a new State with strong religious features in sensitive matters such as the control over births, bridal affairs, cultural and social valuesin a nationalist and sovereignist key.

Parere sulla applicabilità della normativa anticorruzione alle Fabbricerie

1 - Si chiede un Parere sulla applicabilità alle Fabbricerie della normativa anticorruzione. La questione nasce da deliberazione dell’Autorità Nazionale Anticorruzione volta a orientare gli enti di diritto privato controllati e partecipati, direttamente e indirettamente, da pubbliche amministrazioni, e gli enti pubblici economici, nella applicazione della normativa in materia di prevenzione della corruzione e trasparenza di cui alla legge n. 190 del 2012. In particolare l’Autorità in questione ritiene che le Fabbricerie, come tipologia di ente giuridico, possano essere considerate come “ente di diritto privato in controllo pubblico” ai sensi dell’art. 24 bis, del D.L. 24 giugno 2014, convertito in Legge 11 agosto 2014, n. 114 (continua).

Opinion upon the applicability of the anti-corruption legislation at the “Fabbricerie”

ABSTRACT: The “Fabbricerie” do not fall into the category of “private-law entities under public control” pursuant to art. 24 bis of the D.L. n. 114 of 2014, and consequently they are not required to comply with the obligations set out in the legislation on the prevention of corruption and transparency. And this because: they are neither public entities nor private entities, but ecclesiastical entities sui generis, governed by a legal regime negotiated between Italy and Holy See, therefore unalterably unilaterally; their purpose is mainly and directly aimed to guarantee the serving the church and the cult, and therefore it is for purposes other than the public interest as per art. 24 bis of the D.L. n. 114 of 2014; the provision for the appointment of the administrators is not an expression of the supremacy of the public administration.

Codification for the Latin Church. Must we return to the Decretals?

It was during the Synod of Bishops in 1967 that the world episcopate declared their expectations regarding the revision of the Code of Canon Law. They formulated ten principles that should inspired it. Among them, particular attention was paid to those concerning the statute of the faithful and the principle of subsidiarity, critically evaluating the practical actualisation which they then received in the new Code. But, among bishops and the people of God there was also a by far more general expectation to see the very soul of the Council transfused into the Code. The opinions about its actual implementation are quite divergent, also because there is no lack of those who consider the legislative form of the codification poorly compatible with the nature of the law of the Church. However even the most severe critics recognise that the 1983 Code marks a transitional stage of great importance in the life of the Church.

The relationship with Italian Islam: from the proposals of ‘Intesa’ to the ‘Patto nazionale

ABSTRACT: According to statistics, Muslims living in Italy are currently just over 1.6 million. However, despite this significant presence of Muslims on the national territory, the vast world of Islamic associations has not yet managed to sign an Intesa, an agreement that religious minorities can establish to regulate their relations with the Italian state. The reasons why Islam does not have an agreement are mainly two: the absence of an authoritative subject, representative of Italian Islam, able to act as an interlocutor with state institutions and the incompatibility between Islamic cultural values and those of a secular state. Nevertheless, covering all the stages of dialogue between the Italian government and the Islamic associations from the nineties until the conclusion of the Patto nazionale (2017), this work aims to show that the condition of legal vacuum depends on unfounded prejudices towards Islamic culture and on the lack of political will to come to terms with Islam.

ABSTRACT: The current dissertation is mainly going to analyse the original contribution of UNESCO to the development of the concept of cultural rights through the proclamation and elaboration of normative instruments and strategies concerning the right to the protection of and access to the cultural (religious) heritage in contested areas. Since 1967, UNESCO has increasingly played a dominant role in the Old city of Jerusalem: it exercised its power in the field of the preservation of cultural heritage in a contested area, not only through practical plans, but also through legislative instruments and Resolutions. A peculiar political contest is still challenging the full exercise of its powers and the applicability of the main human rights treaty dealing with the preservation of cultural heritage in a contest of competing sovereignty. The essay, drawing on UNESCO's past restoration experiences in ancient (Aleppo, 1992) and post-conflict (Iraq, 2003) areas, focuses on the conciliation role that the Agency may potentially play in the Israeli-Palestinian conflict.

The exercise of the judicial power by the lay faithful through the prism of Potestas gubernandi in Ecclesia. Theological and canonical solicitations for an “outgoing Church”

ABSTRACT: The more than thirty years since the II Vatican Council and the recent procedural reforms initiated by Pope Francis make very topical a reflection on the actual role that lay faithful can exercise within the Church. In particular, by virtue of the Sacrament of Baptism, that makes everyone “sons in the Son”, it seems ecclesiologically inconceivable that lay faithful can still suffer limitations from the point of view of participation in judicial power, especially in perspective of a now-acquired theory of potestas sacra, which, altough it all comes from God, does not require, for each office, the Sacrament of holy Order. The requirements of technical preparation and knowledge of law, the only parameters on which the ecclesiastical authority must be based on the choiche of the judges, impose a re-updating of the can. 1421, § 2, C.i.c. This norm is the only one that deals, in a very limited way, with the figure of the lay judge. Just the recent reform of Mitis Iudex Dominus Iesus, also considering the synodal context in which it has born, would be well matched with an inclusive re-evaluation of the lay faithful in exercise of a ministeriality which is nothing but a concrete expression of the participation to the only mission of the which all the People of God must become executor through the times.

Law as system which incorporates distinct epistemological methods. Why legal reasoning did not retreat before scientific knowledge

ABSTRACT: The central claim of this Article is that, despite the frequent references by legal acts to scientific knowledge, the scientific method has not supplanted or overshadowed the proper features of legal reasoning arising from the idea of law as an autonomous system of knowledge. In fact, just the opposite has occurred. It will be argued that the resistance of the legal at the scientific method can be explained on the basis of three distinct theories of law and legal reasoning: a) the first claims that law is a normative system which is incommensurable with science; b) the second qualifies law as a kind of superscience which grounds legitimacy to science itself; c) the third defines law as a normative system which accepts and incorporates forms of knowledges which the scientific method normally rejects.

The reform of non-profit organizations and Church bodies: a cost, a risk or an opportunity?

ABSTRACT: While many institutional activities of Church bodies fall within the scope of the recent reform of Italian law on non-profit organizations ("NPOs"), the specific features of Church bodies prevent from a straightforward application of the new regime. Therefore, the Code for the Third Sector and the Act on Social Enterprises allow Church bodies to access the tax exemptions and the other benefits provided to NPOs as far as they comply with a set of conditions aimed at bridging the differences between Church bodies and secular NPOs. The paper (1) discusses in details these conditions, (2) offers a critical evaluation of costs, risks, and opportunities related to the new regime, and (3) suggests possible organizational structures to comply with the current system.

The ministry of lector: historical-canonical perspectives and Italian Episcopal Conference particular law

ABSTRACT: The paper intends to analyze the ministry of lector, describing its historical evolution from the minor order to institued ministry, after the motu proprio Ministeria quaedam of Pope Paul VI (1972). Then, the autor proposes an overview of its status in Canon and liturgical laws. Next, the particular law of the Italian Episcopal Conference is analyzed, and, finally, the possibility of the opening of the ministry of lector for women is discussed.

ABSTRACT: The present article argues if, under the interpretation and application of the so-called Historical Memory Law, Franco’s regimen would have set the basis to divest itself as part of the Catholicism that characterized it, in terms of having some symbols that originally would have been considered religious and now they cease to be so, historically and inevitably, at least in a retrospective point of view. In other terms, for the current time to impose a type of victim, although final of Franco’s regimen in the manner of, as a paradox, for some religious symbols to cease to be, without any other possibility for its political use as far as ‘semel francoist semper francoist’ can no longer recover that religious value. This matter, whether it refers, principally to the “Cruces de los Caídos” it can also be argued for it to attain the crucifix and the Virgin Mary located in public places by order of the dictatorial regimen.

Dealing with the contentious points of the integration (about “forbidden” greetings and principle of non-discrimination)

ABSTRACT: Some Islamic believers adhere to a rule of behavior coming from a particular reading of the traditions concerning the life of Muhammad, so they do not shake hands with people of the other sex outside their own restricted family circle. The present paper analyzes the potential impact of such a choice, if it is carried out in the work context and it infringes specific internal company rules, which require employees to not discriminate against customers on the basis of sex. The Author, in accordance with a recent decision of the Swedish Labor Court, affirms that the limitation of the freedom of the worker can be considered a case of indirect discrimination for religious reasons. However, demanding that the woman abstains from shaking hands with persons of her own sex, as suggested by the Court, is not required by the principle of gender equality, and is not coherent with the very personal nature of the act, according to the Author.

Organized violence and religious affiliation: the case of Isis

ABSTRACT: This paper seeks to address the crucial issue of organized violence from a cultural perspective analyzing the case of ISIS, tipically considered as religious group. It intends to elaborate some of the key questions of the debate on the links between religion and violence. The religious nature of ISIS will be disputed throughout its birth and expansion during the U.S. invasion of Iraq and the Syrian conflict: more specifically, the paper aims to shed some lights on the grounds underlying the decision of western foreign fighters and Jihadists to join with or refer to a group of fanatics fighting in the faraway land of Syria. The research methodology is based on an interactionist approach on violence in order to avoid focusing on psychopathological (‘they are violent because they are mad’) or ethical-religious aspects (‘they are violent because they are driven by a bad religion’): on the contrary this paper aims to investigate Jihadist violence in its relational and symbolic aspects, as part of a socio-cultural way of life. In the end, the impact of this approach on possible prevention programs will be touched on briefly.

ABSTRACT: With this article, the Author outlines the legal issues involving the atheism in France, analysing them in the light of the principle of laïcité. France has a long history of criticism of religion. Many philosophes of the Enlightenment, for example, have provided the classical writings in this field. In this sense, they were able to aliment two major streams of thought of the magmatic French atheism: one is based on the horizontal influences arising from the effect of increasing worldwide travel with the discovery that people do not necessary share the same views and beliefs about the nature of human being; the other is centred on vertical arguments bubbling up from the past in a very form of scepticism and realism. With its multi-faceted and articulated view, the French atheism has also been promoted by a number of movements devoted to arguing the case for non-belief and for its political expression in laïcité. In this manner, the Author tries to demonstrate that, since the Great Revolution and during the long history of the French constitutional system, laïcité de combat and atheism has been influencing each other in a constantly shifting process of mutual adaptation.

GMO and low gluten host. The communion of the celiacs faithful: an open question

ABSTRACT: Celiac disease is an autoimmune disorder triggered by gluten in susceptible individuals. Currently, there is no specific medical treatment for celiac disease. The only treatment for this disorder is lifelong adherence to a gluten-free diet. Catholic Church affirmed that bread, to be valid material for the Eucharist, must be made of wheat, must contain enough gluten for breadmaking and must be free of foreign matter. In order to meet the needs of those who suffer from the celiac disease, it has introduced the validity of low gluten. The Circular Letter issued at the request of Pope Francis has not changed the Holy Communion of the celiac faithful. Nevertheless, the document also decided that Eucharistic matter made with OGM could be considered valid matter. The Roman rite finds its theological source in the elements of Eucarist by Jesus instituted in the Last Easter Supper. The sources, however, do not indicate the matter of the bread offered at the Last Supper. So can we say that it was really made of wheat? The solution to this enigma is very important. In fact, it could open up new horizons on Eucharistic matter and on the validity of the gluten free hosts.

ABSTRACT: The problems that derive from the growing multicultural and multi-religious characterization of our society raise a number of questions regarding the difficulties encountered in identifying rules of coexistence that could be genuinely respectful of the ideal and spiritual dimension of the human person. In particular, it is in question the ability of the system of bilateral agreements between the State and the religious organizations to really enhance the individual religiosity, which is constitutionally protected in its instrumentality for the promotion and growth of the human being. Several doubts also concern the discretionary and political selection, exercised by public authorities, of religious organizations deserving an access to bilateral regulation of relationships. In a more and more plural and heterogeneous social reality, the exclusion from the special legislation of the newly established spiritual groups in the country does not seem to be respectful of a neutral and correct interpretation of the constitutional dictate.

The convictions of the spouses on the validity of marriage: incidences on the process

ABSTRACT: The trial reforms introduced by the present Pontificate and the emanation of the Apostolic Exhortation ‘Amoris Laetitia’, in respect of the criterion of “graduality” that inspires the itinerary of the “Church in exit” traced by Pope Francis, do not bring substantial novelty about how “to discern” the convictions of the parties on the validity of marriage. They put into effect, nevertheless, a change of perspective, or rather a different point of view from which to consider these convictions, while still respecting the declarative nature of the nullity judgments, as distinct from legal and pastoral directives on possible epikeia solutions.

ABSTRACT: This contribution discusses the notion of State neutrality in the jurisprudence of the European Court of Human Rights. State neutrality has become increasingly relevant in the rulings of the ECtHR concerning religious freedom, with the Court explicitly resorting to the idea that States should act as neutral and impartial organizers of religious life within their community. Yet, the conception of State neutrality developed by the Court is inconsistent and often gives rise to criticism. By exploring the Court’s main jurisprudence in the context of religious disputes, religious education in public education, and the display of religious symbols in public spaces, this contribution seeks to disentangle the different understandings of neutrality employed by the Court and to critically engage with them.

The controversial offence of blasphemy in the Irish Constitution

ABSTRACT: As recently as June 2018 the Irish Government has approved a referendum to remove the offence of blasphemy from the Constitution; the referendum will be held in October this year. This paper briefly examines the historical and legal backgrounds of this controversial prohibition that survived the 1972 reform of the constitutional provisions in the field of Church and State that, among other aspects, conferred a special position to the Catholic Church, and it does so in order to underline the importance and the potential consequences of the proposed reform in case of an affirmative vote in the upcoming referendum. For this analysis the author gives prior consideration to the fundamental meaning and scope of the constitutional provisions currently in force in the area of Law and Religion and, once this framework is summarized, the paper turns to reflect primarily on the legal and judicial developments that have taken place in the last decades relating the offence of blasphemy in Irish Law.

The concordat dynamics between Holy See and Islamic State

ABSTRACT: The article analyzes the concordat dynamics between Holy See and Islamic States developed after the Second Vatican Council. The concordat, in its various forms, is the main instrument through which is regulated the system of relations between States and Catholic Church. Its use has been tested successfully in various Islamic States, and sometimes even with heterogeneous formulas, because of differences that distinguish the individual systems, trying to translate the concepts of autonomous of Church and collaboration with States in forms legal acceptable to Muslim tradition countries. The exhortations in the Al-Azhar Declaration are directly connected with the possible development of bilateral activities between Holy See and other Islamic countries and this can also strengthen the peace among peoples and the interfaith dialogue.

Beyond the mere terminologic matter, which has also committed the doctrine, given the imperfect clarity of the terms of which the clause is composed, what is at stake is the right of appeal granted to the losing party following a decision “pro nullitate matrimonii”. Legislative innovation must be lowered whithin a broader field of reform, where it’s called to interface with the background of ordinary process and of the new processus brevior, that has the primary goal to chase after the speed-up of processes. The risk of subjectivism in which the judges could fall, focusing on the mere intentions of the appellant subject or on the simple reasons given, and not giving rise to a complete judgment where to reach moral certainty, should be avoided in order to safeguard the aspiration of justice that canon law can not not have, and that precise connotations in terms of faith have only to contribute increasing.

ABSTRACT: The paper examines the clash between public accommodations laws and freedoms of speech and religion in America at the light of the recent decision of the U.S. Supreme Court Masterpiece Cakeshop Ltd., v. Colorado Civil Rights Commission. The case deals with the refusal of a Colorado’s bakery to provide a wedding cake to a gay couple based on the owner's religious beliefs. After explaining the decision of the Court and the position of the U.S. Supreme Court Justices in their dissenting and concurring opinions, the paper addresses the claim of freedom of speech and of the tolerance principle in the pluralistic age.

The substantial contributions that "L’ordinamento giuridico" offers to the systematic and dogmatic understanding of Canon Law are four: law as legitimacy, the conformity between institution and legal system, the neutrality of the law, the non-necessity of the Legislator in order to have true law.

Public relevance of religious communities in the European legal dimension

The religious phenomenon appears relevant both on an individual level and on a social level. In many cases religious experience, on the one hand, helps to draw the personal identity of the subject; on the other, it is an element that characterizes various aspects of civil society, up to the influence of the political and institutional dynamics of many contemporary state systems. This paper intends to demonstrate that the religious phenomenon does not appear confined only in the strictly private sphere, but lives and manifests itself also in the public dimension. This approach seems to be confirmed, among other things, by the new public role that religious communities are progressively taking on in the European legal sphere, as well as within individual state systems in Europe. From the analysis of the rules in force both at the European and national level, this work therefore derives a significant legal recognition of the public relevance of religions and religious communities that are direct institutional expression, paying particular attention to the experience gained in the German law and in the Italian legal system.

Paying attention to the fundamental issues of the social justice is at the core of the existence and the mission of the Church. Nowdays, Pope Francis changed the emphasis of the official social doctrine, calling for a poor Church at the service of the poor and the Earth. This updated social doctrine is founded on the joyful announcement of the Gospel.

Abstract: Jerusalem is the most important city in the world, the Centre of the three greatest religions. It is the Capital of the State of Israel for some, the capital of the State of Palestine for others and for others still a corpus separatum under international control. Everyone wants Jerusalem, and so they contest it, creating political and legislative unrest. These disturbances give rise to violence from both groups of people that live there. In this brief dissertation, we retrace the key historical points and problems associated with the legal status of this city, from the first decades of the twentieth century, to understand that the problem lies in the claim of ownership of this City.

The Third Sector Code: arrival point or starting point for the religious bodies’ palingenesis?

ABSTRACT: Adopted on July 2017, the Third Sector Code promotes social groups to guarantee the constitutional principles of pluralism, participation, social solidarity, substantial equality. The essay analyses what are the most important innovations and the critical issues of Third Sector’s reform, in the law and religion’s perspective and in the canon law’s perspective. Indeed, this legal reform raises fundamental questions, involving Third Sector bodies, that are, at the same time, religious bodies, such as the importance to have in our legal system a general law for religious bodies. Furthermore, Pope Francis’ teaching recalls an ethic dimension in the economic activities for the Catholic bodies.

Female Genital Mutilation as a Gender-Based Crime? (An Analysis of the European Norms in Light of the Concepts of Violence and Religious Freedom)

ABSTRACT: Female genital mutilations (FGM) are ancient practices, which are widespread in several geographical areas, and particularly in Africa. The conflict between customary norms and state legal systems, which arises because FGM violate fundamental rights like the right to physical integrity, health, and non-discrimination based on gender/ethnicity/culture, discloses the dialectic between two normative universes; these universes are conceptually distant with regard to the priority given to the individual and the group. Focusing on the reasons related to female genital cutting (FGC), which consists of the ablation, to differing degrees, of female genital organs, this article, argues that the link that European norms establish between FGM and violence, abuse or brutality comes into conflict with the reasons why migrants perpetuate FGC. Therefore, the way gender is mainstreamed into European norms on FGM can have negative effects, which concern courts’ implementation of these norms and migrants’ social inclusion. Furthermore, this article claims that focusing on health instead of gender equality may prove more effective for the eradication of FGM. Through an analysis of French law, it also suggests that the way the national law is adapted to conform to the Istanbul Convention, may represent a danger to religious freedom.

Lights and shadows of a controversial document: the "Correctio filialis de haeresibus propagatis". Some outlines in Public Canon Law

ABSTRACT: The aim of this essay is to study and to analyze the current debate about recent Pope Francis’s propositions and affirmations regarding the Roman catholic doctrine and the concrete development of religious marriages in secular societies. One of the most important documents disputing the latest reforms and measures could be considered the so called “Correctio Filialis de Haeresibus Propagatis” that is intended to be a sort of manifesto of dissatisfaction and disappointment against the renewal of a comprehensive and tolerant approach in Canon Law’s rules concerning the status of divorced people and the assumed “irregular” civil unions. In spite of underlining some important aspects, probably not completely deepened by the Pope, that document at the same time undervalues the conceptual efforts to make the doctrine adequate to answer to a typical sense of restlessness in our time, even from a legal point of view.

The Foundation, Logic and Content of the Eucharistic Observance of the Precept Regarding Sundays and Holy Days of Obligation

Abstract: This article examines the foundation and ratio of the eucharistic observance of the precept regarding Sundays and holy days of obligation, beginning with an overview of the question within both canonical tradition and current normative logic The historical-conceptual excursus highlights the maine phases of the formation of ecclesiastical discipline, while the analysis of current regulations demonstrates the continuity of normative provisions and eventual refinements. The dimension of justice manifests, above all, the social and institutional value of the precept, while the essential and particular characteristics of Christian holidays are also related to the communal and sacramental nature of the celebration. The logic behind the precept corresponds, then, to the solidarity, historicity, rationality and humanity of its observance. The regard for the “centrality of the Mass” leads to a respect for the substantiality and integrity of the good that is due. The incentive for and rediscovery of the Sunday practice depend primarily on catechetical and formative activity, but cannot be separated from juridical and directive contributions or the responsibility of members of the faithful and pastors.

Freedom of worship and Religious Diversity in English Prisons

ABSTRACT: This article aims to highlight different aspects of the practice of faith in the British prison system. While the 1952 Prison Act gave a preeminent position to the chaplains of the Church of England, in the last decades multi-faith spaces of worship and spiritual-care groups have multiplied. Furthermore, ‘community chaplaincies’ and volunteers are active players in rehabilitation programs, especially in preventing recidivism, which is higher among ethnic and religious minorities. Both the Human Rights Act of 1998 and the Equality Act of 2010 have contributed to promote an ‘inclusive’ approach to religion pluralism, granting access to spiritual assistance and equal treatment among prison inmates. However, it is worth to consider if a State-centred management of religious diversity is a sustainable choice before the growing judicial litigation related to prisoners’ freedom of worship.

Granting Islamic religious ministers admission to prisons, amid long-lasting issues and reformation perspectives. The Agreement between the Prison Administration Department and the Islamic Communities Union.

ABSTRACT: As religious diversity in Italian prisons grows, accommodating prisoners’ religious needs tries legal paradigms and instruments out. In 2015 the Prison Administration Department signed an agreement with UCOII, one of the largest Islamic associations in Italy, in order to grant admission in prisons to intercultural mediators and religious ministers. This article seeks to situate the covenant in the wider context of the Italian legal protection of religious freedom in prison, highlighting three main purposes of the agreement: providing Islamic prisoners with religious assistance, enforcing rehabilitative programs and combating violent radicalization in jail. After two years the experience has shown good evidences. Nonetheless, contended issues still remain unsettled. While evaluating feasible solutions, the article advocates a legislative intervention that could assess criteria and procedures for religious ministers’ access to prisons fulfilling the principle of equality and non-discrimination.

Between religious freedom and security issues: the prevention of jihadist radicalisation in prison

ABSTRACT: Faith constitutes an essential aspect of prison life. Its relevance has been emphasised in recent times because of the religious pluralism that characterises the current prison population. In this scenario, the rise of jihadist terrorism has shed light on the problem of radicalisation in prison, already known and studied by the experts, which poses new challenges for policymakers, prison staff, and detainees. Prison Administration has been focused on religious freedom, its boundaries and its relationship with religious extremism and has already adopted some measures to combat and monitor jihadist proselitism in Italian prisons. This paper provides an overview of these anti-radicalisation strategies in prisons, highlighting unresolved issues. These include the lack of an integrated plan with regards to prevention of radicalisation and de-radicalisation, not limited by the prison context. This paper further highlights the challenges in devising policies that address security concerns without sacrificing religious freedom and diversity, as provided for by the Constitution.

An "UNESCO model" for the economic management of cultural heritage of religious interest?

ABSTRACT: The article is intended to verify if the "UNESCO" management model is applicable to the management of cultural heritage of religious interest, tout court, or if, otherwise, special arrangement are required. Indeed, the UNESCO one is a model not only of dualistic management, (which implies a bilateral agreement), but moreover is inspired by purely economic management criteria. The question is whether a model created for secular cultural heritage can be assumed as a management model also for cultural heritage of religious interest, whose purpose would seem to be incompatible with the characteristics of purely economic management. The author tries to give an answer identifying the common features between the two categories of heritage.

Mediation and Religions: the challenge in a complex society

ABSTRACT: Globalization makes social relations increasingly complex, because it favors the introduction and the spread in the same sphere of a plurality of cultures that are often difficult to combine. The proper task of law, that is the one of regulating the cohabitation of people in an equitable manner, is harder in this context, but it can be enhanced with the help of the mediation carried out by religious communities, though the criterion of complementarity/distinction between the order of political conventions and the order of religious convictions is respected.

Catholic Church entities and the reform of the Third sector in Italian legislation. Canonical implications

ABSTRACT: This paper deals with the canonical implications of Italy’s recent Third sector reform in Italian legislation (d. lgs n. 117/2017) for Catholic Church entities and/or agencies for charitable purposes. It starts with some preliminary remarks on the recent evolution of Canon Law concerning the discipline of charitable organizations and agencies that followed the Motu proprio Intima Ecclesiae natura, issued by Pope Benedict XVI in December 2012. It then examines the general framework of the new regulation of non profit organizations in Italian law, emphasizing the pros and cons (opportunities and risks) of its application to religious entities, particularly those connected to the Catholic Church, which in Italy traditionally enjoy a special discipline safeguarding their canonical structure and purposes. The paper then focuses on the impact of the new civil regulation that allows a wide range of charitable initiatives on behalf of religious organizations, on the governance of Catholic Church entities, which are submitted to the directives and authorizations of ecclesiastical authorities. Finally, it draws some conclusive remarks on the need to update and reform some administrative rules and praxis concerning the administration and finance of charitable institutions in Canon Law.

Marriage and family between secularism and religious freedom

Abstract: Given that between secularism and religious freedom there is a relationship of instrumentality of the first compared to the second, in the essay there’s a recall to the ethical-religious roots of the marriage’s legislation, which, starting from the Protestant Reformation and then from the French Revolution has undergone a process of secularization and secularism with the birth of the civil marriage. It is a process that has been motivated (also) by reasons of religious freedom, but which has led, by the State, to the subtraction of the marriage’s subject from the society. Today there is a substantial return from the state to the society of the discipline about the various forms of life and family communions, and this, in a religiously pluralistic society, involves (also) the return of the marriage to the religion.

La tutela dell’identità delle minoranze religiose deve potersi avvalere di “un giudice e un giudizio” (ancora sulla sentenza della Corte costituzionale n. 52 del 2016)

For the protection of their identity, religious minorities should have “a judge and a judgment” at their disposal (again on the judgment of the Constitutional Court no. 52 of 2016)

ABSTRACT: The article links the theme of the legal qualification of an association that calls itself a “religious confession” in order to have relationships with the State, according to the provisions laid down in the third paragraph of art. 8 of the Constitution, with the theme of the right of religious minorities to have an identity. It intends to prove that the document that the government issues in order to deny such a qualification is not a “political action” exempt from the control of the judicial authority, contrary to ruling no. 52 of 2016 of the Constitutional Court. The identity of religious minorities is protected by the guarantees offered by art. 24 of the Constitution, from which the Constitutional Court draws the supreme principle of jurisdictional protection of rights, the foundation of any democratic system, that guarantees to all, for any dispute, “a judge and a judgment”.

Are the crimes against religious sentiment compatible with the exercise of freedom of expression?

ABSTRACT: The crimes against religious sentiment, provided by the Italian Criminal Code, are mainly framed as “crimes of opinion”. Therefore, it should be ascertained whether and how those crimes are compatible with the exercise of freedom of expression, guaranteed as a fundamental right by Art. 21 of the Italian Constitution. The paper provides an overview of the jurisprudence – of ordinary courts and the Constitutional Court – and of the legislative evolution since 1930s about the crimes against religious sentiment.
