The Atlas of Religious or Belief Minority Rights in the EU: First remarks on Belief Organisations

ABSTRACT: This paper focuses on the first results of the Atlas of Religious or Belief Minority Rights in the EU regarding the legal status of Belief Organisations. The first part of this work describes “Belief Organisations”, focusing on why they are included in the Atlas, and analyses the growth of atheism and agnosticism in the countries covered by the project. The second part focuses on some of the findings that emerge from Atlas data, providing a few (provisional) remarks.

ABSTRACT: Il contributo analizza alcuni primi risultati dell’Atlas of Religious or Belief Minority Rights in the EU in relazione allo status giuridico delle “belief organisations”. Dopo aver delimitato il perimetro definitorio delle “belief organisations”, il lavoro illustra le ragioni della loro inclusione all’interno del progetto e la diffusione del fenomeno ateo e agnostico nei Paesi coinvolti nell’Atlas. Il contributo formula alcune prime osservazioni sui risultati emersi dai dati analizzati.

The Supreme Court’s United Sections on the Crucifix controversy in schools: searching for a difficult balance between laicism and European case-law

ABSTRACT: This paper examines critically, in the light of the Italian and European case-law, the contents and the juridical arguments of a recent decision issued by the United Sections of the Italian Court of Cassation concerning the Crucifix controversy arisen in a State school. The judges established, on one hand, that the crucifix may be hung in a classroom upon demand of the students as it does not infringe the dissenting teacher’s freedom of conscience or of teaching, according to Lautsi ECHR decision (2011); on the other hand, the clash of values involved would need a reasonable accommodation which could require other religious symbols alongside the crucifix or its removal during the lessons of the dissenting teacher. Such a decision, according to the author, appears to be somewhat contradictory and ambiguous, and it does not resolve the case in a well-balanced way.

Are atheists a religious minority? The legal status of atheism in Italy and in some countries of the European Union.

ABSTRACT: “Religion” and “confession” are terms without an established definition in sociology and the legal sciences. The absence of a definition allows us to consider the religious phenomenon in its complexity, including both belief and unbelief. The analysis tries to understand if a common legal discipline is possible for theistic and non-theistic phenomenon. The analysis focuses on the legal status of non-believers minority in Italy and in some countries of the European Union.

Secularism and Bilateralism Thirty Years after the 1989 Landmark Constitutional Decision. The Italian Secularism tested by Islam and atheism

ABSTRACT: In 1989 the Constitutional Court stated that secularism (laicità) is one of the supreme principles (principi supremi) of the Italian constitutional order. On the basis of articles 2, 3, 7, 8, 19 and 20 of the 1948 Constitution, the Court said that secularism does not affirm indifference of the State towards religions; rather, it sustains the protection of religious freedom in a context of cultural-confessional pluralism. With this essay the author examines the way the Italian supreme principle of secularism has developed in the last thirty years, especially in relation to the so-called bilateralism method (as stated in articles 7.2 and 8.3 of the Italian Constitution) and in the light of today’s pluralism, which is characterized by the presence of new collective organizations, such as those referring to Islam and atheism.

The broken mirror of Liebeskonzil: a case of blasphemy in the Wilhelminian Empire

ABSTRACT: In 1895, due to the publication of the play Liebeskonzil, the writer Oskar Panizza was sentenced to one year imprisonment for blasphemy. Starting with such exemplary conviction, the essay reconstructs some aspects of the writer's existential and creative path, treating his vitriolic satires of religion as an access key to the political and social situation during the Wilhelminian Empire, where press laws and targeted use of crimes such as lèse majesté, obscenity and profanity, highlight the tenacity of Government, right-wing parties and Catholic Centre Party in pursuing the common purpose of silencing the opponents of the status quo.

Organized atheistic belief and free propagandistic communication of the ideal-spiritual orientations

ABSTRACT: With an its recent intervention, the Court of Cassation has clearly affirmed that the freedom of conscience of non-believers falls within the broader freedom, in religious matters, ensured by the articles 19 and 21 of the Constitutional Charter. A freedom to be understood also in the negative sense, having to exclude, within our system, any form of differentiation for the protection of the free, individual and collective, explanation both of religious faith and of atheism. In this order of ideas, any limits and prohibitions to the exercise of the right to propaganda of atheistic associations integrate the extremes of discrimination that are incompatible with the constitutional and supranational norms to guarantee the freedom of expression of thought, the ideal and confessional pluralism, the dignity of the human person and the neutrality of public authorities.

1 - Nel tempo della pandemia l'attenzione di commentatori e studiosi si è concentrata sulle limitazioni al (diritto di riunirsi per finalità di) culto. Non sembra avere ricevuto lo stesso interesse un altro contagiato dal virus, ancor più a rischio perché malato cronico: l'esercizio della propaganda in contesto di effettivo pluralismo, sul quale grava il consueto silenzio. Il dramma che oggi tutti viviamo è favorevole a un racconto incline ad accentuare le componenti emotive dei messaggi veicolati, al fine di coinvolgere la platea più ampia di "spettatori". Trionfa così la rappresentazione, fortemente mediatizzata, delle immagini di maggior efficacia, da rendere iconiche per il loro impatto sinestetico: potenti strumenti di persuasione a svantaggio, in un circolo vizioso, delle fedi di minore "ascolto", più che mai senza voce. Dworkin’s Atheistic Religion and the Divinization of Value

ABSTRACT: This essay critically discusses some of the central ideas of Ronald Dworkin’s last book, Religion Without God. In particular, it will be argued that the idea of “religion without God” is not a form of atheism, as Dworkin claims, but a pure religious attitude in which the idea of “theistic entity” of traditional religion is replaced by a new and not less problematic entity, the idea of “value”.

Son passati quasi trent’anni dacché tra le varie dichiarazioni apposte in calce al trattato di Maastricht comparve abbastanza inaspettatamente quella che impegna l’Unione Europea al “dialogo trasparente, costante e regolare” con “le chiese e le associazioni o comunità religiose” non più e non meno, tuttavia, che con le “organizzazioni filosofiche e non confessionali”. Dichiarazione apparentemente innocua, giacché espressamente si esclude che da essa possa essere pregiudicato lo status a quelle organizzazioni assegnato dai diritti nazionali, ma politicamente impegnativa per l’Unione, tanto che fece strada e si riversò nell’art. 17 del TFUE, assumendo così un carattere anche giuridicamente impegnativo. Non-believer’s Europe

ABSTRACT: In spite of the Treaty on the Functioning of the European Union, which puts on the same footing the status of the churches and of the humanist organizations, the status  of believers and non-believers is not the same in each state, regardless its model (the paper quotes briefly the features of United Kingdom, France, Belgium, Italy, Germany  and Malta). The reason lies in a kind of mass religious tradition, which at present is even more hard to defeat because of the rampant populism, which takes advantage also of the religion. The antidote stays in the pluralistic – not monist and excluding the differences -  secularism in order to grant the same dignity of believers also to both differently believers and non-believers.

ABSTRACT: With this article, the Author outlines the legal issues involving the atheism in France, analysing them in the light of the principle of laïcité. France has a long history of criticism of religion. Many philosophes of the Enlightenment, for example, have provided the classical writings in this field. In this sense, they were able to aliment two major streams of thought of the magmatic French atheism: one is based on the horizontal influences arising from the effect of increasing worldwide travel with the discovery that people do not necessary share the same views and beliefs about the nature of human being; the other is centred on vertical arguments bubbling up from the past in a very form of scepticism and realism. With its multi-faceted and articulated view, the French atheism has also been promoted by a number of movements devoted to arguing the case for non-belief and for its political expression in laïcité. In this manner, the Author tries to demonstrate that, since the Great Revolution and during the long history of the French constitutional system, laïcité de combat and atheism has been influencing each other in a constantly shifting process of mutual adaptation.
